When we divorced, the decree states that our son was to live with his dad in Texas. I had agreed to this. However, within a couple of weeks our son asked to come back to Washington and has lived with me since. His Dad agreed to this so we did not alter the decree; just made our own agreement.

My ex-husband no longer has a residence; has been with a girlfriend and living in his car etc. He recently indicated an attempt at suicide, was hospitalized and now is to be in a State hospital in Oregon for two weeks.

At this point I am concerned that when he is released he will want contact with our son and may attempt to take him. He made verbal remarks about this desire previously.

What can I do?

My wife and I are still legally married but about two years ago she took our younger son to Washington with her for a three weeks vacation. After two weeks she called and said she was staying. Shortly after she got there she applied for welfare, now Washington is coming after me for child support and wants retroactive for my younger son even though our older son was living with me the whole time. The retroactive is over $8500.

Also, in the paperwork it says she thinks I am a threat to our children, I have never had any arrest of records of domestic violence. Because of this all of my sons information is being held confiedential.

She also self prescibed zoloft to my oldest son for two years.

Nine months after my ex-husband and I spilt up he got involved with the Nigerian scammers. He was offered a profit if he would pose as this person who had a trust, appparently this person had the same name as he has. Haven't we all seen these scam letters in our inbox?.

He negociated terms and wired large sums of money he borrowed and sent a couple of laptops he bought ( to "prove he was serious"). He signed himself as the beneficiary on the trust to recieve a loan against the said trust. He recieved a check for 55k and deposited it into a private credit union. He proceeded to wire 50K of the 55k to a bank in Canada. Shortly thereafter the check was found fraudulent, leaving a -55k in the bank account. Now although we had been separated for nine months, and I had no knowledge of his business transaction at the time, I was held responsible by the bank because I was still listed on a joint account with him at the same bank. Note, although he made this transaction in his sole account, they debted all accounts he was first on. I consulted an attorney on the military base and he called the bank and concluded that I was responsible because I had signed something when the account was opened that gave the bank this right.

So my husband was destitute now and I was severely indebted. I took a second on my mortgage to pay the debt and spared my credit. I had the husband empty his 401K account to pay all he could. He agreed to pay me back on the loan. The following day after I discovered the defficet in the bank account, we had our court hearing for a legal separation. At the last minute we managed to make note that he would be responsible for the negative bank account on the court papers.

Thereafter, he made payments to me for about seven months before he decided not to pay anymore. I Motioned for a judgement stating that the debt arrouse from fraudulent activity on his part with a fraudulent organization. I did get the judgement order, however; now the ex has filed chp 13 bankruptcy.

The judgement order is dated Sept 14, 2007 and his first filed chp13, Nov 28, 2008. He dismissed his first chp13 And a week later later he refiled his chp 13 showing less income. He claimed a "financial burden" since his new wife wasn't working anymore. Her job quickly dissolved after I requested his paystubs and checking account statements which proved the 5 yr. plan.

He dismissed his plan due to "financial burden", however, I was objecting to his plan for several months due to the fact that he error on his stated income. I should also mention that the wife's unemployment status only lasted for 6 weeks- just long enough to make a difference in the length on the chp 13 plan. also, she went back to work at the same company as before and she was back at work three days before the first plan was dismissed. She claimed unemployed on her new chp 13 documents, but submitted two check stubs showing emplyment.

Now that he as refiled I have a problem, or not, I'm not sure. although the divorce papers don't mention the fraud, the judgemnt motion and declaration do. My only fraud exhibit was the cancelled check stamped "fraudulent" accross the face. The Judgement order itself does not mention the fraud, but the motion and declaration do.

I would like to prove fraud either in the civil or bankruptcy court. I can perhaps augue his intent which is easy to prove since I have all documents. Question is- would the court allow for a clarification on the judgement order in the civil court? Was the one exhibit enough even though I have the signed document of him trying to get a ficticous person's money? I could probably have the automatic stay lifted to pursue this in the Civil court, but what are the chances they will clarify and acknowlege the fraud intent and add the fraudulent working o the order? Clearly, if he was being an honest person, this would not have happened.

If I cannot get this clarified in Civil court, I might be able to fight dischargeabilty in Bankruptcy Court. Which is best? Any advice? It has been seven months since the judgement order was recieved. Is it too late and would this be considered a Clarification or modification? This might make a difference as to how the judge would rule, or if he would even hear the case.

I should also mention that when we filed the show cause motion the ex never opposed the fraud issue. He never challenged it, probably would not have stood a chance anyway.

Also, I don't know if there is anyhing I can do about how they refiled the case to manipulate their income.

I am currently dating a women who has two children in custody of the State of Washington. They have told her that she can not have a felon around the children while they are in custody of the state. We are serious about our relationship and she is trying to get custody back. What are the rules and regulations regarding a boyfriend who is on probation, doing well and who's conviction is from 2001 for drugs. Any advice or suggestions would be great. Thank You.

The children moved from WA to WY with here father and than went from WY to Texas to be with there mother. My children and I live in Washington state and my ex husband resides in Idaho state. In November 2008, my ex petitioned Washington State Superior Court for a modification of support to reduce his child support obligation. Prior to this, I had received two partial payments in 2004. Washington State had suspended his driving privileges and in 2005, he served 30 days in a county jail for contempt/nonsupport.

In the paperwork, I received from the prosecuting attorney's office my ex stated he could not work due to an injury. I proceeded to challenge his claim in court. Paperwork indicated that he did receive several months of Washington state welfare, along with medical and food stamp benefits. It was when Washington state said he was fit to work he applied for the modification.

I was thunderstruck as was the Washington state attorney when my ex admitted to working 40 hours/week in Idaho State. He actually said he was working under the table! He also admitted to fraudulent action against the state of Washington by receiving Washington State Welfare while residing in Idaho State for the previous eight months.

Also, my ex stated that we was making child support payments all of 2004 and 2005 while working in Washington State for the same roofing/construction company that had employed him since 2000. He was making more than $20/hr. However, the Department of Labor and Industry for Washington State only reported his employment through 2003. When asked why the company did not report his earning for 2004 and 2005 he replied that that was a question for the owner of the company. My ex stated he was a full time employee of the company and not and independent contractor.

At no time did my ex apply for unemployment and stated he was working full time throughout 2005. Because he stated his paychecks showed deductions for child support in 2004 and 2005 I am surprised he has never challenged the back support owed to me in the stated years. I assume his boss had taken him off the books. I reported this to Washington Department of Labor and Industry and the IRS.

I suppose my ex lost track of his lies and forgot the 30 days he served in a Washington State County jail for being found in contempt of court. I have a transcript of that day court in 2008.

My question: Can I ask the court for my ex to reimburse me for attorney/legal fees I incurred in 2005 for having an attorney file contempt action? In Washington State Superior Court, he raised his right hand and swore to tell the truth. As I said, I have the court transcript. How do I go about this?

When I finished paying my attorney in 2005 said she could no longer represent me because she felt guilty about taking my money. I have been on my own ever since... Working under the table still works for my ex. Currently, I am receiving partial and sporadic child support.

Can I take him back to court for contempt? If I do not stand up for my children, I would not be fulfilling my parental responsibilities. Thank you.

What is the name of your state (only U.S. law)? Oregon residency / Washington courts

My brother's divorce was finalized earlier this year. He was paying $1000 / month in c/s for his two kids with their mom as primary residence, which bumped up to $1200/month after the finalization. He was in a job that allowed him to pay that much at the time, but throughout the past 6 months or so, the ex has taken him to court for various 'contempt of court' charges, all of which have been dropped. Due to him being taken out of work so many times, his boss 'asked' him to take time off to get things straightened out.
He is currently on unemployment making the max he can, which is nowhere near what he was making with the job. He is lagging behind with his child support due to him just not having that much money anymore.
The ex's last 'contempt of court' (court date of 7/20) did rule in her favor, as he said he has to pay all his back support by September 1st, 2009. (Currently, he is around $4000 behind)

My questions include:
What will the court do if he cannot pay by that date?
Why does the court state that he 'can be making that much money' when the ex is assumed $900 / month income? (aka, why do they assume he has to make the money and she doesn't have to work?)
Is it possible for him to file something to get the child support lowered due to not currently working? Does it backdate to when he lost his job?
Isn't the court only allowed to take a certain % of his paycheck?
Should he try to re-file in Oregon since they both live in Oregon now instead of WA?
Should he still be having to pay child support if the primary residence has switched to him? (He has primary for the summer months, she gets 1st/3rd weekends)

I sold my house 9 years ago and had a house built with my fiance on property he owned but owed on. My name isn't on the loan but it is on the title to the house. I put money into having the house built and had $12,000 in a joint savings.

6 years ago, my son and his son which my son was driving were involved in a car wreck which his son was killed. He took my name off our joint savings. We have tried to hold it together but the grief is taken its toll and June 30th, I had him arrested for domestic violence. He pulled my hair after a screaming match.

On August 4th, I appear in court to try to have the restraining order lifted. We have had no contact with each other. I am living at my mom's but all of my stuff is still there and I paid this months bills, utilities, car and medical insurance and boat payment that is joint.

I would love to work this out but I don't want to screw him over but I need to protect myself since I don't know what he is thinking. I know he blames me.

Hi I am in Washington state and I have a HUGE dilemna...
Just to make a LOOONG story short, there is this young girl (19) who is the mother of my stepsons baby. He is in work release right now because he hurt him when he was an infant, so they sent the girl, (who i will call madame x) away back to another state to take the baby and live with her parents. well there was a custody case and we havent heard from ANYONE in that state except we know it didnt go well for madam x and the stepson.
my husband recently got a call from her saying that she had gotten FULL custody and was moving to washington a month ago and that if he(being the childs grandfather) wanted to see the baby, he could do so at any time...
we knew to stay away because she is just a liar. thats all she fells comfortable doing. well, the grandmother called and said that she witnessed madam x get on the plane to come here to washington BUT there was no baby. so my husband called the parents and indeed the baby is ressiding with them!
I read te girls myspace page and she was posting lies and accusing me of hurting her son, She posted a BLOG saying tht she was going to tear me apart and make me suffer so i wrote her an email to let her know that we knew the truth and to quit with the threats. she myspaced me back and we went back and forth a couple times. nothing serious.she then emailed me and i printed the email with the threat to "make me pay and suffer for tearing her family apart"
the next day i was gathering evidence to get a restraining order against her but decided to put it off a day. well, Last night she served ME with one. An anti - harrasment order.
heres where i need the help/advice. i have NEVER threatened her. on her application for the order she says that i email her every day, follow her to school ( i didnt even know for sure she was in wa, let alone where she lives and i dont think shes in school) , she says that i need to stay away from er son and his daycare... ???????? her son is not here. i have NEVER followed her. havent even seen her face since she arrived in wa.
ALSO...i just had majorsurgery the day after she emailed my husband and am still recovering. i have ben home 90 % of the time plus i babysit my 2 year old grandaughter. i take medication that i cannot drive on (especially with my grandaughter) AND i dont have a carseat.

The father of my 15 year old son is now trying to pursue joint physical custody after 15 years. My son visits him 2 times a year even though there has not been a visitation order. He has filed in the State of Illinois and I have been trying to get it dismissed, as neither my son or I have EVER lived in the State of Illinois.

I have filed a motion to interene in the dependency of my granddaughter. I just learned that CPS told my daughter who is in treatment, to cut all ties with me including calls or letters if she ever wants to see her daughter.

How can they get away with this?? I mean my daughter is an addict but she's still my daughter.

Some collateral information: I am a licensed drug and alcohol counselor and I have passed their background check, so my back ground is not an issue. What IS at issue seems to be they are uncomfortable when I ask them questions that hold them accountable. How can CPS get away with dictating who my daughter can speak to on the phone or write? Is this an additional cause of action?

Okay in an extension of the last post....today Mother and father have reached an agreement and a compromise so that both parents can spend as much time as possible with child. Father had to give a little bit and mother had to give a little bit but an agreement was reached at the end.

So my question is we cant get a hold of my lawyer....he isn't contacting me back and hasn't since last week when he told me he was really busy. I assume he is but what can we do to get this new parenting plan signed and filed? Can we just sign in front of a notary?? Is that legally binding? Plus if father writes a letter that states mother can move this weekend (which was the original move day) and also has that notarized....will this be able to be held up in court, if it ever were to strangely go there?? I doubt it would but I want to make sure every loose end is tied so that nothing could be changed or twisted.....

any opinions on this?? Any advice would be greatly appreciated. Thank you

I just got a return call from my daughters dr office, saying they cant give me information until they get a copy of my divorce decree stating I can receive it. I know legal custody gives the right to decision making, but isnt a parent entitled to the information UNLESS its stated otherwise?

Who's responsibility is it to prove? Mine that I can or his that I can't (which isn't the case)?

I'm ESPECIALLY furious because they talk to stepmom no problem.

OK...the saga continues. I keep asking for a divorce. I want to keep my family home that my alcoholic/porn-addicted husband refuses to maintain in any way at all other than paying the bills. He says I cannot make it without him...but I WILL FIND A WAY. I want him out. He threatened that if he did leave, he'd quit his job and I'd never see a penny from him again. I said "fine. go." He hasn't. Kids are grown...marriage is almost 29 yrs long...he has a union pension that he is now eligible to receive if he retires(30 yrs), but is working a few more years to make the monthly bigger...I work PT and have a part-time pension that I won't be able to collect for about 15 more years....but it will be small. I make about half of what he does but I have excellent benefits and do not want to leave job for FT, so I could work a second job if I had to. I was a stayhome Mom for many years so I wasn't able to establish a FT career as we both felt it was important for me to be home with the children(hence the PT as well). Am I still entitled to 1/2 his pension even tho I have a future teeny one of my own? And how are those kinds of things awarded?? I KNOW he's not going to voluntarily hand over half his pension. He swears he isn't going to give me a cent. What am I entitled to from him? I know I could win an at-fault divorce filing. Any help would be appreciated. I'm the mother, I'm in Washington state. The kids live with my ex husband who is in the military in Wyoming but we got divorced while we were all living in Arizona.

My ex husband has legal and physical custody of our children ( ages 4 and 8) and I was given supervised visitation at my expense with the children because of my mental illness at the time and my drug abuse at the time...I am now nearly a year clean off all drugs, stable on my meds, and in college full time.

I get to see the boys twice a year, for about 3 days at a time, while they stay at my mother's house-summer and christmas break. I miss my kids and I want another chance at being a mom.

Is it too late? Is there something I can do to prove I am fit now to take my kids for the summers or something? We do not have a parenting plan and I don't know where to begin-Washington, Wyoming, Arizona...I am low income, on state assistance and I do not have money for a lawyer.

How do I get a parenting plan in order with mandatory visitation rights even if we live in different states?

I am the custodial parent. Myself and the child's other parent have been in a battle over our child's teeth. I am looking to be educated on the topic as I cannot find anything concrete within the Washington state "abuse" descriptions. The child is under 5. My pediatrician advised that children "typically" see a dentist once a year starting between the ages of one and three and a suggested visit of every 6 months after the initial.
I took the child to the dentist a year ago. During said visit, which was an adult dentist mind you, they did not take X-rays, but rather looked at the child's teeth and informed me that the child had 3 cavities. There was no clear plan of action which was outlined to me after this other than they were not adult teeth and would fall out eventually. I did not get them fixed.
Bring it to current time. The child went for another dentist apt. The child has 11 cavities.

There are dental visits, a completely new diet, rx toothpaste and rx mouth wash all in place to fix the current dental health state, as well as instill a dental foundation into the child, and both of us as parents, to solidify that this will never happen again.

My question is; can someone file for a change of custody based off of dental health. Could this be used to find me an unfit parent?

I am speaking very vaguely as I am beyond the point of harassment and abuse from the child's other parent and step parent over every issue imaginable. I am frustrated, and scared frankly as I have been told verbatim that "there is a file" being kept which will someday be used to secure custody of the child away from myself. The term "abuse" is hyphenated as this verbiage was used from the child's other parent directed at myself referencing my parenting style.

I am looking to arm myself with facts and figures or just an answer so I can prepare myself.

I then moved far away. Now my daughter is interested in getting to know him, and to be honest I could use some financial help. I haven't pursued getting any kind of support from him. He lives in another state. I recently found him online and he still isn't interested. I found out he also has more children with multiple mothers. I know I did the right thing when I walked away from him, but what kind of process would it be to try to get some support from him? Also, what kind of rights would he have if he had to pay support? I don't believe he has a criminal record, just an immoral one. Thanks

My daughter is heading to drug addiction treatment again for the 4th time and CPS has my 3 yr old granddaughter.
Granted..this is an emotinal time for familes-when CPS is involved. I just hired a lawyer on the 30th of June to prepare a motion to intevene in the case of the dependency of my grandchild. With my daughters history, I'm worried CPS will move for adoption as soon as they can. They don't seem to like me but no one can understand why. My lawyer said I call her too often and to back off and let her prepare the motion. I agreed to wait two more weeks before checking back. Is a month enough time to prepare a memoradium and motion for the court? or am I too antsy? This lawyer seems very good and knows CPS matters well.

I mean, I want to be fair but everyday that goes by, is another day this baby is with strangers in foster care.

What are the chances of mom relocating with child after filing a relocation and then father filing an objection? (meaning the chances that the courts we agree)

Mother is moving for specific job and needs the job. Mother has full legal and physical custody of child. Father has limited supervised visits with the child totally 16 hours month. Parents were married and there is a PP on the books that stipulate the visitation and custody.

If courts agree to move what would a parenting plan look like for a longer distance father/daughter relationship??

If courts do not agree, what happens to to the currect PP on the books?
