  <description>I'm the non-custodial parent.  I'm unemployed, and medically ill.  The custodial parent wants me out of the childs life.  I havent seen the child in 5 years.  I have paid child support ever since.  Me and the custodial parent have both agreed upon for me to relinquish my parental rights, and for her mother to adopt her.  Will this end my child support?  I live in Indiana, but she has since moved to Oregon.

  <description>When we divorced, the decree states that our son was to live with his dad in Texas. I had agreed to this. However, within a couple of weeks our son asked to come back to Washington and has lived with me since. His Dad agreed to this so we did not alter the decree; just made our own agreement.
 

My ex-husband no longer has a residence; has been with a girlfriend and living in his car etc. He recently indicated an attempt at suicide, was hospitalized and now is to be in a State hospital in Oregon for two weeks.
 

At this point I am concerned that when he is released he will want contact with our son and may attempt to take him. He made verbal remarks about this desire previously.
 

What can I do?

  <description>I live in Alaska and pay child support to the State Of Alaska to which they send it to Oregon where i have 2 support orders at. The state of Oregon only requires $1034.60 a month but the state of Alaska withholds $1560.00 a month which i cannot afford. Oregon told Alaska we didn't need that much but Alaska still withholds that amount. What can i do? This is so time consuming.

  <description>daughter died in january 2009.  leaving 5 year old granddaughter.  on final day of daughter's life, while everyone was gathered at the hospital, I (step grandmother) suggested we call an attorney (i'm the level headed, non-emotional one).  the grandmother jumps up and says &quot;what for?&quot;, there is nothing to leave in a will.  my response is to remind everyone that there is a 5 years old girl who will need raising and knowing that the family does not want the father involved, to protect their rights, a guardian must be appointed. 
 

well, the grandmother jumps up,says she already has the paperwork (unsigned) and proceeds to contact the hospital to get a notary to have the mother (on her deathbed) sign papers giving custody to her.
 

now, that is not a problem until after the daughter passes.  the grandmother now has custody and is playing &quot;power&quot; with the granddaughter.  as the other set of grandparents (the father of the daughter who passed away), we have to beg to get the granddaughter for a visit.  we are not allowed to talk to her on the phone nor see her without the grandmother's permission.  
 

we (the father and I) miss the daughter who passed and need to keep connected to the granddaughter.

  <description>My ex husband and I have 50/50 custody over our son when we got divorced a few years back. However since then my ex husband has moved to Oregon and the shared plans we had in writing has changed by our own doing. Zackery my son spends the school year with me and the summer and breaks with his father.
 

My issue comes with me wanting to move to WV with my son, can I do this legally without having to get my ex's okay as long as I am welling to keep the same agreement we have or would I have to go back to court?
 

I think getting my ex's okay for me to move will be a problem because his mother is close to my son and right now I live right around the cornor from her. 
 

If anyone can help that would be great thanks!

My brother's divorce was finalized earlier this year.  He was paying $1000 / month in c/s for his two kids with their mom as primary residence, which bumped up to $1200/month after the finalization.  He was in a job that allowed him to pay that much at the time, but throughout the past 6 months or so, the ex has taken him to court for various 'contempt of court' charges, all of which have been dropped. Due to him being taken out of work so many times, his boss 'asked' him to take time off to get things straightened out.  

He is currently on unemployment making the max he can, which is nowhere near what he was making with the job.  He is lagging behind with his child support due to him just not having that much money anymore.

The ex's last 'contempt of court' (court date of 7/20) did rule in her favor, as he said he has to pay all his back support by September 1st, 2009.  (Currently, he is around $4000 behind)
 

My questions include:

What will the court do if he cannot pay by that date?

Why does the court state that he 'can be making that much money' when the ex is assumed $900 / month income? (aka, why do they assume he has to make the money and she doesn't have to work?)

Is it possible for him to file something to get the child support lowered due to not currently working?  Does it backdate to when he lost his job?

Isn't the court only allowed to take a certain % of his paycheck?

Should he try to re-file in Oregon since they both live in Oregon now instead of WA?

Should he still be having to pay child support if the primary residence has switched to him? (He has primary for the summer months, she gets 1st/3rd weekends)

There child support order is through the state of Oregon because that is where they originally lived.  She moved to Missouri to get married 7 years ago and he moved to Iowa where he had family 5 years ago to be closer to his children.  She has since moved one more time in Missouri, two times in Illinois, two times in Oregon, and now lives back in Missouri with another family of 4.  The children are tired of moving, have no friends, currently have no possesions because they live in a house with 8 people in it and there is no room for their things.  The 12 year old wants to live with his father and I in Iowa.  He is terrified that he will be shot and killed in school this fall because of what he has seen where he lives now.  He has no stability and hates the people the lives with.  His mother won't let this happen because she doesn't want to lose the child support, as both her and her husband are unemployed, and child support is their only source of income.  First of all, in which state would my husband file for custody at this point.  Second, does he have a chance to win? And third, can his son live with us while custody is being determined so we can get him enrolled in a school he is not afraid of attending?

  <description>My daughter is 3. Her mom has supervised visitation. My wife and I have a 2nd child and my wife stays at home with both children. I work very long and unpredictable hours. I am wondering if my wife needs POA to take my daughter to doctor/dentist appointments. For the last 1 1/2 years she has just carried around a note from me saying that she has my permission to seek medical care in emergency and non-emergency situations. The same type of note that I would give a daycare or babysitter if my daughter were in childcare. My wife does not pose as mom and everyone knows that she is step-mom. So far, she has had no problems getting care for my daughter, I just want to be sure that she doesn't have any problems in the future. Also, my daughter will be starting an early education program this year and I want to be sure that my wife will have no problems picking up my daughter or getting information in my place. Thank you.
