Can my ex husand withhold my child support as reimbursement for legal fees he was awarded for me to pay?
My ex filed a motion to withhold my alimony to pay the mortgage since I cannot obtain my own mortgage. We settled outside of court with me agreeing to him doing so. He also wanted me to pay half his legal fees and my attorney agreed to it. Now hes withholding my child support money as repayment for 2 months. Is this legal or can I fight him on it? How do the attorneys expect me to take care of my kids on my small salary alone for 2 months? Its going to be a hardship? Who do I contact to help me? I live in the state of New Jersey
I never agreed to this part of the settlement, my attorney did without my knowledge. I paid her 1500.00 to help me and now I owe 1000.00 to my ex husband for his attorney..remind me thank her for this mess!

My Ex as I've said in past posts is a Professional con person. Was sentenced to 8-12 years in jail and was out in 90 days. She for the first time was paying CS regularly 4 week in a row, because of probation, yet is still 20,000.00 in arrears.
As of yesterday I checked the on line website and it says arrears Zero. I called CS and am told it's zero because that's what the computer says. I was told it's entered by the court system not them.
I called the court house and am told there's an Order and that's it. Wouldn't even read it to me. I asked and explained I'm a thousand miles away and have never been notified of a thing, have the same address and phone for 6 plus years. They won't even send me a copy of the order. I was told either come get it or file a new motion.
In many of my other post I mentioned she has a family member who works in the system and has tried similar things before.
What do I now have to do?

OK here is the deal I had a fight with my ex, I bit her defending my self when she was kicking me inmy groin. She lleft the house and lefyt the children with me. I took the kids after a couple of days and went to my sister's house in upstate new york.
She went to the police and filed a complaint that I bit her and took the kids away form her "even though she is the one who left the house with her own well leaving the kids with me". The state persude 2 chgarges against me : 1- interference with custudy. 2- Aggrevated Assult, though my ex decided not to persue further actions, and told them we are back together. My lawyer got me into this deal on getting probation for one year "this is my first crime in my whole life", and I wasn't aware of the assult charges being aggrevated one.
My question is: can I back off from this deal, as i really don't feel comfortable with the second charge, and it will ruin my professiional career. " not to mention that i really was defending my self"....if yes, how long would it take to settele this. Is it an alternative when the judge dismiss this after probation to change the charges from aggrevated to simple assult.
I will add one more question: after the probation is over, is it possible to retry the case and dismioss the previous charges?

| My 19 year old son was just emancipated by the NJ courts for failing to be a F/T student. His mother would register him as F/T and give me the schedule then he would drop classes. I finally obtained a copy of his transcript and put it all together. I had paid over $5000 in support that was by deception. My question is can she refile for child support again if they decide to pull this scam again?

I have 2 separate problems so this will be long I apologize.
Problem 1:
My soon to be 5 year old will be starting school this September. I have residential custody of my son. I made a verbal agreement with the father during the end of my 2nd pregnancy. I agreed to week on week off instead of the 3 overnights previously agreed on by us signed by the judge. (We are allowed to change days and so forth per the court ordered agreement) We made this arrangement so our son wouldn't spend the time with my mother.
After I healed from the delivery and surgery I spoke to the father informing him as such. Then mentioned the fact that maybe we could keep it this way until our son starts school since when he does start school his fathers visitation would be cut. He said that that would be wonderful. Two months ago after the meeting with the school his father agreed to the school and so forth. I told him that we need to work on the new visitation schedule and he said no he wants to leave it the week on week off. I refuse to this only because his father lives one hour away when there is no traffic. i told him he could have every weekend and all holidays minus Christmas and Easter and alternate his birthday. He still said no.
My father was kind enough to take the drive several times to see the approx. travel time, my son would have to leave his fathers around 5:30 in the morning to reach the school but 7:55. My sons father does not have a license so his father would be doing the driving on his way to work. since i don't know what time his father has to be at work it is more likely that my son would have to be dropped off at my house earlier than that anyway. and considering my son would also leave school before his grandfather would leave work my son would come home to me when school lets out. my father was also kind enough to to the drive back home several times as well if his grandfather gets out at 3 he would be at my home by 3:30 and my son wouldn't get to his fathers home until 5:00 and if his grandfather gets out at 4 he wouldn't be at my house until 5 and my son wouldn't be at his fathers until 6:30 7 o'clock. My sons bedtime is 8 pm, He would never get any sleep. This is why i refuse to allow this.
My sons father also suggested that i can drive him back after school i have a 9 month old and i will not put her in the car like that everyday. then his other suggestion was his mother would pick him up, i said no that is a violation of the court order. I have court scheduled for the end of august can't make it any sooner. If this does drag out is there anything I can do to make sure this doesn't happen during the first few weeks of school?
Problem 2: (This is shorter)
My 12 and 9 year old nieces (my sisters kids) have currently come to live with me for the past 6 months while their father is in prison. He says that it will be at least 2 years before he is released. My eldest niece has made many friends and does not want to leave my home, she would like to graduate with her friends. She informed her father of this and now he is threatening to have the girls removed form my care and placed in the care of is friend. We did sign a letter stating i would have temporary custody of both girls and i received a legal document from the courts that i have custody for the time their father serves. (it was for insurance purposes) Can he really have the girls taken from me without taking me to court or is there something i can do to prevent this?

After 12 years of marriage I need a divorce. I can no longer live with this behavior, his affair, and need to just end it.
My question is, in the state of New Jersey, when I file for divorce and my husband is served can I ask the court to have him leave the marital home, that is in his name only, within 15 minutes or so that he is served? I will assume all responsibilites for the household until and after the divorce.

| New Jersey. A friend of mine is in a difficult situation. He is in the military and has been married for less than a year. He wants a divorce and wants to have joint custody of his unborn child. The problem is that he was on a paid website for people who want to have taboo sexual experiences. A woman he met on there (never in person) added his wife on her myspace and asked her if they were married. She then told her that he said he wasn't and that he was into certain things. His wife kept a copy of the conversation. Now she cheated on him, but i guess he doesn't have proof. So I have two questions. Can she get him kicked out of the military? Can she get full custody of the child because of that?

| OK...the saga continues. I keep asking for a divorce. I want to keep my family home that my alcoholic/porn-addicted husband refuses to maintain in any way at all other than paying the bills. He says I cannot make it without him...but I WILL FIND A WAY. I want him out. He threatened that if he did leave, he'd quit his job and I'd never see a penny from him again. I said "fine. go." He hasn't. Kids are grown...marriage is almost 29 yrs long...he has a union pension that he is now eligible to receive if he retires(30 yrs), but is working a few more years to make the monthly bigger...I work PT and have a part-time pension that I won't be able to collect for about 15 more years....but it will be small. I make about half of what he does but I have excellent benefits and do not want to leave job for FT, so I could work a second job if I had to. I was a stayhome Mom for many years so I wasn't able to establish a FT career as we both felt it was important for me to be home with the children(hence the PT as well). Am I still entitled to 1/2 his pension even tho I have a future teeny one of my own? And how are those kinds of things awarded?? I KNOW he's not going to voluntarily hand over half his pension. He swears he isn't going to give me a cent. What am I entitled to from him? I know I could win an at-fault divorce filing. Any help would be appreciated. this came up in another thread and i didn't want to hijack it. i've mentioned before that my stepsons call thier mothers boyfriend daddy and sometimes daddy hisname. my husband has talked to thier mother about this and she just says oh well they just started calling him that on their own. now we were told before by someone who used to babysit the kids that he would tell them to call him daddy. he talked to thier mother again and she blew it off.
last weekend we were driving in the car with the boys and they said something about daddy doing something. my husband was like, "no i didn't", his son said, "no, not you daddy hisname". my husband said, "he's not your daddy, he's hisname". and his son said, "well we're not allowed to call him hisname". he asked him who said that and he said her boyfriend did. he hasn't had a chance to talk to her again, and i'm not sure it would do any good.
he did meet with a lawyer a few weeks ago. in the last court order it says that "custody shall revert to joint between mom & dad at the end of the school year." the lawyer said that since my husband had legal and physical custody at the time it refers to joint legal custody. he said that for there to be a change in custody she would have to go into court and file for physical custody. the lawyer told him basically if it ain't broke don't fix it and to just leave it the way it is. so at this point he doesn't really want to rock the boat. but, could the kids calling her boyfriend something he would be able to bring up should she try and file for phsyical custody?
also, i've read on here that in some states the ncp can pay child support. i'm not sure of the proper wording. but, i'm wondering if new jersey was one of those states, or if the person who was the ncp would automatically be the one paying support?

| I have a case in where I tried to leave my husband and allowed children to go overnight with husband, but he took them and went to police saying that I was unstable and had attempted to commit suicide. DYFS and Court appointed him temp custody, and did not inform me until I tried to retrieve my children. DYFS ruled allegations to be unfounded and said i had to complete pysch. eval., In court husband beggeed judge for supervised visitations but would not comply later on with schedule. When pysch eval. was complete judge ordered for parenting classes, counseling and stress management classes DYFS met with me and said everything was fine No problem if kids move in with me as long as I continue to attend classes which I'm doing, Now husband is tiered of children and wants to dump them on me without talking to the court, what can I do?? I want my children living with me and DYFS said ok but hubby won't tell the courts and doesn't want to, my mother would be liable in this instance and what if court denies fathers wishes what then??

| why is it that most NCPs have wages garneshed for child support , but when the NCP owns the company, his kids have to wait till he get's around to sending it into the county CS ageny? if he has an established bussines why can't the bussines' account be garnished? is this ever done? I'm sick of my kids being owed thousands by their dad who makes plenty of $$$. enforcement has been difficult since he moved to Ca. any advice?
