NH Legal QuestionDaughter fears her mom
Child Custody & Visitation
I have Joint custody of my 16yo daughter, with her mother holding physical custody. My Daughter was caught in a lie and I informered her mother, who is now over reacting. My daughter is at my house and her mother is coming here to talk tonight. My question is this: If my daughter does not want to leave with her mother, can my ex wife legally make her leave? Did I mention my daughter fears for her physical safety, from both her mother and step father.

NH Legal QuestionProceeding Pro Se
Child Custody & Visitation
Incredibly contentious custody case has been raging for over two years now, and has brought me to my knees financially with legal costs over 60K to date.

Recently, my attorney filed a motion to withdraw due to my inability to my outstanding balance with his office. I don't want to be Pro Se, but I simply can't afford to keep paying all these people.

We have a (child support) hearing scheduled for the 10th of August and to that end, I immediately filed a Pro Se Appearance and served a Request for Production of Documents on the opposing counsel.

Opposing counsel then emailed my former attorney saying that I had contacted her directly, and until the court rules on the motion to withdraw, that she would not speak with me, but would only speak to him (more costs ).

I understand that there is some merit to her position, but the court does not usually "rule" on withdrawals, particularly when it is followed by a new Appearance.

I want to also file a Motion for Contempt to be heard the same day, but should I wait? My attorney filed a Motion to Continue along with his withdrawal, but I'm afraid the court will deny the continuance and don't want to be unprepared.

What to do? Do I have standing to file such motions?

NH Legal QuestionQuestion about moving
Child Custody & Visitation
Hi. I have a court date for custody of my daughter on 8/17/09 with my ex (never married). I want to know if I move back to New Hampshire before my court date with my daughter, does Ohio still have jurisdiction since the court date has been set? Also will this hurt my case? Thanks so much!

NH Legal Questionis this how things usally go??
Child Custody & Visitation
NEW HAMPSHIRE

I have full custody of twin daughters. There mother lives in i guess what u could call a safe home for women and children. She has two other daughters (not with me) she has custody of. She recently took me to court so that she could establish visitation with the twins. There mother and i live a hour away from each other. There mother has NO means of transportation and nothing to offer as far as transportation goes. so the end result i had to bring the children to see there mother every saturday for 4hrs find somthing to do in her town and then go get them and drive them home. I went to court again for a review and i explained that myself providing the rides seeing i didnt put us in that situation was a little unfair (i thought). So now the new order is every other saturday 8hrs (still same amount of driving) i just dont know the legal ins and outs but is this how it usually goes or is there any action i can take to mabye bring fairness into the picture.
