  <description>When filling out a financial declaration and you have a spouse with joint bills, and separate bills how would you include those in the financial declaration?
 

Mortgage? Loan is in his name only but both me and my husband contribute. Do I take the loan payment and split it in half, or since it is in his name do I leave the line blank?
 

Same for power, cable, internet, and other loans? Some is in my name, some is in his name, but it is all for both of our benefit and we both contribute to all. 
 

Also, I pay for health insurance privately, but the only line item I see is for payroll deducted health insurance which if I list it there and attach my paycheck stub it will not match up. Should I list it under other expenses and attach a health insurance bill?

  <description>Hi - Divorced in 2008, have custody of children.  SPP states medical and extracurricular to be split per income.  High percentage - 90+% - of items submitted to me for reimbursement by NCP are not covered by the SPP (or any other court order).  Things like food, mileage, parking, gifts, etc.  It takes hours to make sense of and then provide info stating why items aren't covered.  NCP has a strong tendency to not do as agreed and ordered, but to do as they think it should be done.  I am only able to get closure by going back to court.  
 

From a legal perspective, is the NCP doing anything wrong where I have legal recourse?  Can I go back to court to stop NCP from these fraudulent submissions?  
 

Thanks!  I am looking forward to opinions and comments on this.  I figure I'm not the only one this happens to.

  <description> I have custody of my son from the age of two years of age . He is now 14years old . He is spending the summer with his father. His father is remarried to a women in the military. My husband and I get a phone call telling us my son wants to live with him. His father is currently behind in child support. My son e-mails me telling me he is old enough to decide who he choices to live with. i responed back telling him until your 18 you can't decide. His father e-mails me saying I'm keeping him from him and I don't care for my son because I want let him live with him. He has 4 more years of school and his family lives here. Can you give me advice to address this.

  <description>My Ex as I've said in past posts is a Professional con person. Was sentenced to 8-12 years in jail and was out in 90 days. She for the first time was paying CS regularly 4 week in a row, because of probation, yet is still 20,000.00 in arrears.

As of yesterday I checked the on line website and it says arrears Zero. I called CS and am told it's zero because that's what the computer says. I was told it's entered by the court system not them. 

I called the court house and am told there's an Order and that's it. Wouldn't even read it to me.  I asked and explained I'm a thousand miles away and have never been notified of a thing, have the same address and phone for 6 plus years. They won't even send me a copy of the order. I was told either come get it or file a new motion.  

In many of my other post I mentioned she has a family member who works in the system and has tried similar things before. 

What do I now have to do?

  <description>My sister is 14 years old she is in a group home because my dad and step mom do not want her around them. I know my dad hits her and my step mom i do not know if he hits the other 4 girls or not
 

I just want to know is there away i can get my sister out of the group home and have her come live with me. im asking this because the group home she is in is about to close and i dont want to see her get hurt.
 

She is in NC and im in Pa

  <description>I have a very confusing question. I am stationed in North Carolina, my sons live with their mother in the state of Georgia. I have visitation with them over Christmas, and 1 month during the summer. My 17 year old wants to return, no problem with that, and my son that is almost 16 wants to stay. Their visitation is almost over and I have been told that I can not force him to go back if he wants to stay. My original custody case is in the state of Kentucky where we divorced. Nothing has been changed since 2003 when she moved to Georgia. All I did then was allow her to move out of the state by signing the court paper. It seems like alot, but I am willing to go back to court and file the necessary actions to get him to stay, but school will be startig very soon, and I would much rather he start here than go back and end up switching later. He approached me with this so I don't know what to tell him? Thank you for your time.

  <description>I am a US citizen (born in the US) and moved to the US from India 4 years ago. My uncle from North Carolina became my legal guardian with consent of my parents. I went to high school in NC and now go to college (out of state) at Georgia Tech. I still list myself as a legal resident of NC.
 

The question I have is this: I am 19 years old, an adult- but am I still considered a legal dependent of my uncle? Can I still call North Carolina my legal residence since my uncle lives there? If so, what is the age limit until I become an &quot;independent&quot;?

  <description>I am thinking about trying to pursue my own divorce. I do not have money for the legal expenses a lawyer requires. I have ordered the book required to file the proper forms, and have been to and spoken with my local clerk of court. However on inspecting the various forms I am asked for gross income amounts and tax info. etc. of my spouse. I do not know these things and we did not file our 2008 taxes together. We own a piece of land together (we did have a house, but he let it get foreclosed on because he wouldn't make the payments) he wants to keep the land. I do not want anything from this man except a divorce. No equity, no distribution of property, nothing. So will I need to be required to list his assests, even though I do not know them, his net worth etc. If I do not want anything from him? Thanks for any help.

My husband and I have been having a rocky relationship for a while now. He has no income and no way to pay mortgage, childrens' expenses, etc. In the past when I have asked him to leave he has refused and stated that if I'm not happy I should leave. I feel that I am able/have been paying household expenses and should not have to leave. Anyway, a couple of weeks ago we had a heated argument and he did leave, went back to a state we had formerly lived in and turned himself in on an outstanding warrent. He is currently incarcerated, but may stand to be released in the next month or two. He tells me that he misses me and would like to return, but I have had enough. I am afraid that he will break into our home (he is on the mortgage) while I am at work and refuse to leave. Is there any way to keep him out of the home? By the way, he is not violent, just stubborn.

 How long should one wait to file contempt for non-payment?

DCSS is in charge of the case but from what I understand I can request that they file for contempt. 

NCP is over $70 thousand in arrears. Has paid a total of $700 in the past 6 years when the first support order was made. 

A new order was made 7/7/09. A wage assignment was sent. 

Just found out from DCSS today that NCP quit his full time job and his two part time jobs as well. Previously NCP had his license revoked by DCSS due to non-payment. He was given a temporary license to find work in which the time period will end August 1st. As far as I know NCP is still working under the table.....also know that it is nearly impossible to prove that type of employment. 

When a parent is charged and jailed for contempt how long do they stay in jail for? 

There are also issues with citizenship status. Considering I am the Ex I can not get information on his status. Born overseas, Lived here in the states, fled overseas, then moved back recently)  with a temporary Visa. I don't know how long those last or how to find out if his is valid. 

Any help would be great.

  <description>My wife and I seperated over a year ago. We were married for three years. Our incomes were very similiar (with my two jobs I might have made maybe 2500 a year more). I am a social worker. I don't make much money.She is a teacher. During the year of seperation I did my best to help her financally (paying for utilities, paying for her credit cards, paying for my car and her son's car payments-both of which my wife and I have joint auto loans on). I ended up working seven days a week. A few months ago my wife decided to seek the advice of an attorney. When she did this I did the same. I sent her a proposal from my attorney. Her response was to sue me. Her complaint wants alimony and attorney's expenses. She seems to also want some type of post seperation agreement in addition to her alimony. I have two questions. The first is: My attorney is in another county-the county where I live (other than where the complaint is filed). Would I be better served getting an attorney in the county where the complaint is filed. My second question is I am almost bankrupt. My present attorney states that I might soon qualify for bankrupcty. Would it be better to file for bankruptcy now or wait until after my divorce is settled. I think my wife believes that I am hording money (which I'm not). Her finances are actually worse than mine. She has just recently lost her job as an asssitant principle, however she has a master's degree and can obtain employment. Any suggestions would be helpful.

  <description>I am desperate mom, I don’t know what to do or where to go, I filed for divorce in November 2007, I moved with my baby son, who was 18 months at that time and for 1.5 years his dad had visitation every other weekend, he helped with some child support, a total of $1500 total during that period of time.

He was unemployed for 8 months on 2007, got a job, moved out a state for 4 months until he got fired again, now is a waiter.

Moved in the house we had together with his mistress.His parents bought the house for him, i left everything and run away to a hotel because he had threated me he will take my baby away since I was pregnant

I had to work very hard to provide for my baby, as much over time I could.

Finally court date came and after 7 hours hearing, judge took some time in “advice” and 3 weeks later he ruled to take my baby away from me and have visitation and pay a ridiculous child support.

we have joint custody and i am the NCP

My ex, lied so much in court was “a drama queen” and his ability to create stories was shown, he knew how to play the system, he accused of everything but could not probe anything, just some witnesses that lied with him too.

I filed a motion for new trial/ reconsideration, but the judge denied again!

Nobody that knows me could understand why this judge took this decision

Of course I missed my baby so much; he is being exposed to meretricious environment.

Dad just uses him to hurt me.

I need help, i can't pay that child support, there is no OVertime available and I need more time with my babyWhat is the name of your state (only U.S. law)?

  <description>What is the name of your state (only U.S. law)? north carolina. here's my situation. i allowed for my son (derrick)to live with his father, the first 7 yrs of his life. derrick came back home stayed with me and his brothers for a few years then went back to tenn with his dad. derricks father and i have never went to court as far custody because we didn't feel there was a need to do so. I paid child support ,court ordered to his dad while he was in his custody. i didn't have a problem with paying, i even got it set up where it came directly out of my paycheck. here's where it gets wierd. now that derrick is back home with me, i'm trying to get support from his father but for some odd reason, when papers are delivered to the home he stays at, of course his girlfriend states he doesn't stay there. now my son wishes to go back to tenn. and i don't think it's fair because i know that his father only want to get benefits from the state, ie..food stamps, afdc, child support..my one question is if i give up parental rights for my son, through the courts am i still liable to pay child support.

  <description>Have an er hearing for child pick up on the 30th of July.  Mother is a drug addict and has neglected the children.  Also she has removed them from there home state of florida without consent of father or courts.  I have two people that will testify to the neglect and drug use.  I am not sure what kind of questions I can ask the mother in the interrogatory?  Can I ask her about two seperate Emergency room visits that disclosed he use of drugs and also the neglect of the children.  Also I am not sure what discovery is and if it is just for getting information and docs that she plans on using or if it is meant to disclose our discovery to the court as well.  I am the grandmother and my son is the one filing all this with my help. Does he need to subpoena myself, one in North Carolina and one in West Virginia? Also, one of the witnesses in west virginia would have to be intereviewed by phone, how do I do that?  Do you have samples of interrogatory and discovery motion?

  <title>Police Officers decide custody???</title>

  <description>I apologize if this is not the right area for my question. 
 

Officers recently took my nieces 2 year old nephew and gave him to his grandmother against the wishes of my niece.
 

The grandmother is well known to DSS and the local police for her criminal history and child abuse and endangerment cases involving her own children when they were young.
 

 As a result of this she has been bared from being alone with or having any type of custody of this child by DSS. She has made several attempts in the past to get the child by calling DSS on my niece. Each time it was ruled that my niece is a fit parent and the accusations are unfounded. 
 

My niece told the police officers that the woman was not to have the child and for them to please stop her from leaving. They told my niece there's nothing they can do and that they have rules to follow. 
 

The police were NOT acting on any court order or helping a DSS worker to remove the child from the home and there was nothing wrong with the home the child was living in.
 

My question is: Would my niece have grounds for a civil suit against the dept. simply for removing the child from the home with no legal reason to do so?

  <description>why is it that most NCPs have wages garneshed for child support , but when the NCP owns the company, his kids have to wait till he get's around to sending it into the  county CS ageny? if he has an established bussines why can't the bussines' account be garnished? is this ever done? I'm sick of my kids being owed thousands by their dad who makes plenty of $$$. enforcement has been difficult since he moved to Ca. any advice?
