Hello my wife and I have a situation as follows, our son had a child with a lady who is now his ex-wife they divorced and he gave up all parental rights (foolisness for sure) and now his ex will only let us see her in her presence and wont allow us to take her over night and we use to get out grand child for weekends numerous times so to answer one question yes we have been a very very big part of our grand daughters life untill the last 6 months wich we have only seen her maybe 4 times when it use to be every weekend for the most part prior to them divorcing... I want to now does our son have any rights to get visitation rights granted they divorced in april 09 and we are hearing we can bring babys mom to court for grand parents visitation by filing a petition against her? History on son was arrested for drug trafficing then for spousal abuse they threatened to make people tesify and make him look bad wich he has a history and relations very strained to say the least with his parents (us) so he signed over sole parental rights to his ex... but he assumed he would be able to have visitaions rights and she says no thay he has no rights to her any longer....

bottom line grand parents are suffering greatly over this and have done nothing but love and provide for this grand child...

any info would be appreciated very much.

Ok don't know if this is something anyone can answer me but trying to make heads or tails bout something.

I have the divorce papers sent to me in the mail form when i got divorces last year. I am getting ready to get married again and when going to the city hall to get the paper work for the new marriage was told that the papers i got in the mail are not good enough and i have to go to the court house and pay to get a certified copy form the courts.

Can anyone give me a good reason why the city is doing this. All I got for an answer form the city was that they don't consider the papers sent to a person form the courts after the divorce to be certified and such.

Going from Primary Residence, mom just got 2nd DUI and violating conditions of releas

Currently my husband's daughter's primary residence is with her mother. We found out just this weekend, thanks to the newspaper, that last weekend his daughter's mother received her second DUI and also violating conditions of release. It's obvious that she has a bit of a drinking problem. My husband tried to go for primary residence of the child a couple of years ago and unfortunatel did not win. A Guardian ad Litem was assigned to the case because my husband requested it, but unfortunately the Guradian had a heck of a time trying to meet with my husband's ex because she was conveniently never available and also the Guardian did not look up the DUI that my husband told her that his daughter's mother had received recently so that made my husbands claims of her having a drinking problem only looked like him trying to make her look bad on top of the other things he told them that she has done in the past and recently. Well now she has gotten her second DUI just last weekend according to the newspaper, which I'm assuming this time is going to result in a longer jail sentence than just one weekend. This is obviously leaving my husband wondering when and if this woman is going to tell him that she might be spending some time and jail and where she plans to send their daughter during this time. We've decided that this might be a good time for him to pursue the primary residence thing again because now her first DUI has be recorded in the file (thanks to the clerk of courts, she's such a good woman) and we have the newpaper showing the second DUI arrest. We've also kept track of other issues and text message, etc. that show other problems we've had with this woman on top of the fact that this little has had some significant behavioral issues all of sudden this past year in school. Behavioral issues that don't happen while she's with us or on the Monday after she's spent the weekend with us, when she goes back to school (her teacher gaves us reports each day and kept in pretty regular contact with us regarding her behavior). We want to make sure that everything is done correctly this time around and that my husband makes the best effort to get his daughter into a better home environment. So we are wondering if this seems worth the time and effort to pursue for primary residence. There were some things that fell through the cracks the last time around that my husband said he's going to make sure are taken care of this time because he's not agreeing to any arragnement until everything is covered. Any advice that we can get is extremely helpful. We cannot afford a lawyer for this because we've just had a baby and my employer decided that right before I had the baby he needed to cut my hours at work which hasn't left us much extra money to save up for the $3,000 for retaining a lawyer. So we are looking at any information we can get from any reliable source.

What is the naHme of your state (only U.S. law)? Maine

Hello,

My wife and I are sperated and we had a lawyer make up speration/settlement papers wich dispersed all our assets and states all child support and allimony issues clearly as well as any 401-k and retirement accounts and states its to be incorperated into the divorce if we reach that point. The question I have is now that its been signed and notorized do we need to file it with the Maine courts?

We had a lawyer generate the paper work and we handled the signing and notory because we are agreeable with it all. We just didnt know if it would be legal as is or if it needs to be filed with the courts?

thank you.
