Automatic change in child support? |
| Child Support |
| Can child support payments be altered automatically without a court hearing? Support payments have been the same for over 2 years now. After checking this week it has changed by about 50%, along with a recording saying this is what it will stay at. I havent gone to court or received any papers. My daughter just turned 4 years old. Could her age have something to do with it being lowered automatically somehow? Confused.

Trying to make up for mistakes...Anything I can do? |
| Child Custody & Visitation |
What is the name of your state (only U.S. law)? MD
Hi. I am the father of a 4 year old girl. I have basically missed the first 3 years of her life, by my own stupid choices. I brought mother to court to set up visitations. We went thru mediation and she gave me a decent schedule after a few supervised visits. Me and the mother have a bad history, which is mostly my fault, alot of lying, jail time for dwi and weed, verbal abuse etc. I have tried to change from this but she isnt sold on it.
My concern is that my daughter doesnt always want to come with me for my visits. She will hold on to her mother at dropoff time and say she "just wants to stay with mommy." Sometimes I get angry about it and walk out just telling my daughter "its not your fault". There are other things my daughter has said about not wanting to call me "daddy", "real family/fake family" which she says comes from the Stuart Little movie (has a "fake family" in it) but I think the mother is putting things into her head and trying to disrupt my relationship. She doesnt deny any visits or anything like that.
The mother does contact me about our daughters "problems" thru emails but I have been ignoring them. I feel like she is always saying its all my fault, even though those are not her words. I feel like she just wants me to leave or something.
I have been searching the net and forums and I see things like Hostile Aggressive Parenting and Parental Alienation. Are these things that I could prove in court? What would be considered proof of this? Could this be just normal behavior by my daughter bc of my absence?

Petition for Contempt |
| Alimony & Spousal Support |
| During the divorce hearing my exwife lied and exaggerated her health conditions to gain sypathy for Alimony. She was granted it but was also required to file for disability. I do not think she has done this since she is not ill enough to qualify. I want to file a petition for contempt in that she has not followed this order. Should I include a letter that states I feels she lied in her testimony or just file the contempt petition stating the court orders she has not complied

Ex-spouse will not transfer vehicle title |
| Divorce, Separation & Annulment |
| My 2008 MD divorce decree incorporates but does not merge my voluntary separation agreement. The agreement directs my ex-spouse to take action as necessary to permit transfer of a vehicle to me as sole owner. I have moved into VA and the title still has both our names as owners. She refuses to comply and I am faced with suing for contempt of court order and also pursuing ex-spouse payment of legal fees. Is there another way? Will a divorce decree and separation agreement be accepted as evidence of my sole ownership in MD and VA?

Life Insurance Policy-ex has new wife as co trustee for son |
| Divorce, Separation & Annulment |
Hello,
I've been divorced since 2004. In our divorce settlement, my ex was to hold a separate life insurance policy for himself for our son's benefit, with our son as the beneficiary. I was to be the co-trustee. He verbally informed me that he had this, yet for 5 years refused to show me proof. I ended up going to mediation with him (voluntary) twice. He brought the policy with him, but refused to give me a copy. He said "get a lawyer". So I did. The lawyer got me a copy. It listed our son as the beneficiary, me as the co trustee, and his new wife as the co trustee. Apparently, he can list whomever he wants as an additional co trustee.
I suggested to the lawyer that to help keep the peace,he possibly make anyone (his mom/dad/brother or sister) as the co trustee besides his new wife. He refused. His new wife and I do not have a good relationship-I even have a protective order against her.
We are currently scheduled for court in September to resolve this. Can the court make him take her off the policy or do I still have to deal with the new wife even if my ex were to (God forbid) pass away?
Thanks for any help!

Modification CS Hearing Outcome |
| Child Support |
I've gotten advice recently from this site and it has been helpful. I thought you might want to hear of the results of my modification hearing I had last week.
I filed to have my CS lowered due to a change in my position (resulting in a different pay schedule) that does not include any OT, so my salary decreased about $30K annually. I also asked to have my ex's salary imputed because she only works P/T (1-2 days per week).
The judge did lower my CS; however, he would not impute my ex's salary she's a physician) - he said that due to the economy times are hard, and since ex says there's not much work in her area, ...... he can't/won't impute her a salary. I showed the Judge the Department of Labor's estimate of what she should be making annually, but he would still not impute her salary.
My question is, should I appeal the Judge's decision since my CS is much higher because she is voluntarily unemployed? My CS payment would decrease by approximately $300 - $400 per month if her full-time salary was used. Or since Judge's can be subjective about issues, should I just drop it?
I appreciate your previous comments and your future ones also. Thanks.

Custody of granddaughters |
| Child Custody & Visitation |
My husband's son passed away in April and left 2 daughters. We moved our granddaughters into my husband's sisters house along with their mother, who lives in Maryland where our granddaughters live. We live in South Carolina. Their mother doesn't have a job and is using drugs. Their mother was asked to leave the house due to taking drugs and stealing money.
What are the chances of us being able to get custody of them and what do we need to do? We have contacted Social Services about this.
Thanks
