Father came from texas and picked up children to take them to Michigan without any notice..he actually came while I was at work and my daughter called and told me that they were packing and that teh father was here at my house helping my son pack!!!!..I then left work and came home, I asked why he didn’t tell me that he was coming to pick them up and ...he replied that it is ok.and would not answer any more questions and proceed to leave with the children..He advised my kids and also told my sister that he will have them for 7 days and would then send them back.
I spoke with my daughter and asked her what time was the flight, her father who was in the background told her not to worry about it, this would be between he and I. He then later texted my daughter to ask for my phone#, in which, I know he has. Once she gave it to me, he called me and asked me if I had something to write with..I was in my work van driving back to my site at the moment..I was thinking that he was about to give me flight information in which he began to give me a number to his Lawyer in Texas..I asked why was he giving me this and he stated that he now has custody of the kids because I did not show for court and told me that I will need to sign his proposal stating that I would no longer accept any child support from him and that I will agree to pay half the cost of a flight each month for the children to come and visit him in Michigan. I told him that there is no way that I will agree to that and that he is lying about the judge granting him custody when I did not get the court order until a hour before court in which I called the courts and left several vm explaining why I was not there..I even asked if they could call me and do a phone conference or maybe re-schedule for a later date..I never heard back from them…He then proceeded to tell me to call his attorney, to discuss the issue. I called his attorney, who refused to speak with me. I then called the child support office to see if they had received a modification to the order in which they stated they hadn’t. At this time I was very upset and crying, I then called the courts to see if they had any information, I was told that they could not give me information over the phone and that I had to write to the courts to receive the orders. My daughter then called and could hear that I was upset..she asked what was wrong and I first said nothing, but she kept asking and then told her that they may be staying a little longer..at this time, she began to cry, I told her it will be ok and that I will come to pick them up if he didn’t send them back..I asked her not to tell my 10 yr old son. Her father Mother and Grandmother seen her crying and she told them that her Father wanted to keep them and they wanted to come back here, the mother responded by saying that her father was going to buy plane tickets once she takes him to cash his check and the grandmother stated that she would try to send them back if their father didn’t. My daughter then went outside where her father was still crying and telling him that she wants to go back home..he told her that he didn’t want to see her cry and after he speak to me he will send them back…He had already spoke to me and I did not agree with his proposition, therefore, he would not answer about when they could go home.
Right now my kids are thinking that they will be coming home tomorrow but he is still waiting for me to sign his proposal before sending them home..
What is my rights and can I file parental kidknapping? Pls help!!!!

| I am married and have been for 16 miserable years. I have 3 children with this man. Their ages are 2, 13, and 15. I have been verbally, emotionally and mentally abused throughout this entire marriage. I finally decided I do not deserve this and have been wanting to leave for about 3 years. It took me this long to act on it because I have seen this man angry before. He threatens me, breaks things, disables the phones and yells and screams for days if I make him angry. I am wanting to go and live with my father in Louisiana (where I was born and lived until I was 26 years old) but I have been a resident of Texas for 5 years now. I also want to take my children with me. The problem is I don't know if I can do this legally. I don't want to be charged with kidnapping or even worse, have him be able to take my kids from me. But if I file for divorce here, I have nowhere to go. I do not want to have to take my children to a shelter. I want to go home! I have friends, family and job prospects there. Is there a way to do this without my husband's permission? After all, he isn't even a good father. He buys my oldest son cigarettes and he is also addicted to prescription drugs. I am desperate!Please help!

I have been having issues with my ex not paying his child support on time. He's never more than a month late and basically skates between the lines of enforcement. I have been taunted by him several times that there really isn't anything I can do about how he pays support since he never gets more than a month behind. I was told by a friend residing in California that with child support you can have the state garnish wages for a direct deposit option for payment and they do this whether the other party is behind or not. Does anyone on here know if this direct deposit option with wage garnishment regardless of being behind or not is an option in the state of Louisiana and how to go about obtaining info on it. Also if this is something I can do without a lawyer. I'm currently back in school trying to finish my nursing degree and am basically broke. Thanks in advance for any advice any of you may have!

SOME BACKGROUND:
I have a very close friend who has 2 small boys. The father also has another older child by another woman whom he said was his UNTIL the mother seeked child support. Then the child wasn't his. He avoided the court papers for paternity and the court proceeded without him and ordered support. Which he now owes thousands. This same individual is avoiding a regular job but working for cash. He also has warrants for his arrest for not showing up in court repeatdly for a number of traffic violations. Has a criminal history related to theft and other things. He has threatened in emails in the past to take the boys and leave the state so they aren't raised by the mom. He has not held a job for more than six months over the past 7 years. I am truly being conserative on this information about him.
The mom on the other hand has worked steadily, she has provided for the boys. Now that she has gotten older, as she was a young teenager when she became a mom, has finally come to the conclusion he will not change, she is trying to move on. Like the time before he is once again using the threat of trying to take the children away. She doesn't even really want child support just the threats and control issues to stop. The only thing going against her is she resides with one of her parents home with the boys because she doesn't make enough to afford a place. She hasn't seeked government for ecxept for medical for the boys, she wants to show her kids responsibility and good work ethics. As I said before, she has worked, provided for them.
She is confused as what information she needs for a lawyer, if she has a good case at getting custody. She has asked my opinion and knowing the father mine is very biased, so I told her I would seek some opinions on line.

| my wife and I got a divorce and she had primary custody, two yrs later her parents took our child from us getting temporary custody. my exwife and I had no arrest record at all and it was all hear say that was made up. Her mother is a court balif and I am sure that made things easier for them. When they first took him, they served me papers and tried to serve her but couldnt find her. I went to my court date and the judge ordered me to a hair test for drugs. I took it and came out I was clean. I havent been able to get the judge to meet or talk with me since and cannot afford a lawyer. what are my rights in this situation now? Her mother will not let me see my child?What is the name of your state (only U.S. law)?

I am currently pregnant from my ex-boyfriend. He wants to have paperwork drawn up for me to sign. In the paperwork it will say I will not go after him for child support. Is this legal to do? If I sign the papers and he bails, will they hold up in court if I need child support from him for the baby?

I have been court ordered to carry my daughter on my insurance plan since 2006. Father's wife added our daughter to medical coverage without my consent in 2006 throwing off the Primary Carrier. We worked out some kinks, and medical coverage is fine now.
Now, father's wife just recently got a new job. I just learned from my daughter's dentist office that father's wife faxed over coverage for my daughter. SHe is court ordered to have NO contact with my daughter's school, doctors, or anyone else when it concerns my daughter's upbringing or health. I believe that is parental interference? I'm not sure of the term. Anyway, I have excellent coverage and do not need a secondary insurance carrier since they would only be paying around 5 bucks per visit and they are out of network.
Here is my question. Since step-mom added my daughter without consulting me, don't I have the right to call her insurance provider and cancel? This is actually costing more money because she has a deductible, and I do not. SHe is saying that since my daughter is already added, that she is unable to take her off of the plan. The dentist office informed me that they will not have to bill both insurance carriers since they know about each other now.
Please advise.

The child in question will be 19 years old in one month. She attends a Junior College in another state (MS). Louisiana law states that the age of majority for child support payments can be stopped at the age of 18. It also states in LA Rev. Statue 9:309 (C) that child support is allowed to continue over the age of majority if the child is unmarried, a full-time student in good standing in a secondary school and dependent on either parent. Questions are: 1. Does my divorce and child support order HAVE to specifically state that child support will continue through college? 2. Is a Junior College considered a secondary school? 3. What does good standing mean? Is there a specific GPA the student must have? 4. What is considered full-time? How many hours must the student carry? and 5. If the child now lives with the custodial parent, which is in a different state than the one the divorce/child support was filed in, which state law is to be followed?
