i need help. i was married when i was 18 and had a baby with my husband. we got divorced right after my daughter was born. and my ex-husband didnt put his name on the paper work for the birth certificate. and he never sent it off to be filed either. i dont know if he is the actual father of my daughter but he has visitation rights from the divorce and custody thing. he has only seen her 5 times since she was born. i dont know what to do. do i legaly have to put his name on the birth certificate or can i leave it blank or put unknown in the spot where the fathers name goes. i havnt been able to get ahold of him to see what he wants to do so i am seeking any information on what is and isnt allowed in this situation. it has been a year since the birth of my daughter that is why i am wondering what is and isnt allowed in this situation. do i have to put his name down at all.

| I live in Kansas but the custody battle for my son is in texas. his aunt and uncle got temperary custody three years ago. this march they gave him back said they were going to sign him back to me but have not. what form do i need to change the resdience of my son so i can have the court case in kansas instead of texas, since i live in kansas and my son has lived here with me since march went to school and is seeing a therapist in kansas. the therapist thinks that his aunt and uncle should not see my son I am his mom and social services were never involved. texas just went on hear say. I never even got to see a judge. they kept postponing court and i ran out of money..His biological dad is in jail. He hasnt had much to do with my son since he was four. the uncle is my sons biological dads brother.

What is the name of your state (only U.S. law)? MI
I am asking this for a friend of the family.
Mom left dad and kids in AR- waited five years and filed for divorce in MI. Minimal contact with the children during those five years. Children are 13-12 and 9 now.
While in court for the divorce, the dad asked the judge, "What happens if she does not return the kids".. judge said then you contact your lawyer. Judge also stated that any future custody disputes would have to be filed in AR, where the children reside.
Mom called dad this year near the end of her 6 weeks and asked if they could stay a couple weeks longer, dad said yes they can.
Mom called dad yesterday and said she is not returning the children and that she appealed the courts decision and he would get his papers on Monday. Then said she is returning the youngest, but not the others.
Mom sent a text today telling dad he should have been in court the day she went over custody if he wanted rights. Inferring she has been to court since the last court order. This is the first he has heard of this, never served or anything.. not even sure she is being honest about it either.

Names of children and dates of birth- all children of this marriage. Court acknowledges it does not have jurisdiction of these children since they have lived in Arkansas for several years, and still reside there.
Parenting time.
Parties have agreed to allow six weeks of parenting time with plaintiff (mom) every summer.
Then later in the agreement it says that court maintains jurisdiction to enforce this order and should either party cause legal action the one found in default will be held responsible for all legal and attorney fees incurred.
I told him to contact the courts first thing tomorrow to see if there is in fact a custody order for his children there.
Where does he go after that, does he file here for contempt, does he file in MI. Does he need to file an ex-parte for the return of the children with a motion to show cause?
School starts the 19th- children have attended school here all their life.

My husband basically has had problems paying his child support due to a loss of his job and we have received a document this morning from a sheriff:

YOU ARE THEREFORE COMMANDED to be and appear before the (our county) County District Court, sitting at (Our City), Kansas on the 24th day of August 2009, in Courtroom xxx at xx:xx o'clock of said day and show cause, if any you have, why you should not be punished for contempt of court.

Is he going to jail?? What, at this point can we do to avoid him going to jail? Would paying the amount in full help this situation. He is about to start another job and we have two of our own children at home to take care of as well. Anything we can do to keep him out of jail and making things worse, please any advice on this matter to remedy the issue.

| My son and his wife are divorced and she has custody. The mother does not want to retain custody of the oldest child and my son is unable to care for him. Both parents are not responsible and spend time back and forth in jail or in some kind of trouble. Their 12 yr old son wants to live with me, his grandmother. I can't afford to go through an attorney at this point in time. What can I do to get custody or guardianship. I am trying to divorce my husband but not sure how to proceed.
We were married in Las Vegas during April 2006. I lived with him in Kansas City Missouri. After a few months of constant fighting, I left the marriage and moved home to Rio. He has refused to divorce me and will not file any paperwork even abandonement papers.
How can I proceed to divorce him? I've contacted an American law firm in Missouri but have not heard back. What can I do?

My attorney withdrew from my case and the judge i don't think has signed off on it. I had a contempt case against the ex for lack of child support and health insurance.
I emailed my attorney and asked him if he can dismiss the case since i filed it (i was going to get rid of him after i did anyway). So i haven't heard from my attorney at all to know if 1.) the judge signed off on his withdraw and 2.) if he can file the dismissal of the case since child support enforcement is actively pursuing it since the attorney isn't (its been 2 years).
I was told to call the courts and ask about dismissing the case well, they can't even tell me if the judge signed off on it, let alone tell me what the status of anything is. So I'm in a bind and not sure where to get answers at.
So, how do i go about getting the case dismissed so that KCSE can go after him for it?
Like i said i am not getting any answers from my attorney or from the courts and i have a 2 hour trial on it in early august. I do know KCSE has already sent out a letter to intercept, but what i do not know. Their attorneys are for the state and not me and can't get any answers from them either.
I did find a form on the county court house it's with to dismiss but i'm not exactly sure what i need to do.
Would it be worth it if a local attorney could help file and all that with the dismissal, I'd pay at least for that. I do not rely on the child support and haven't since it was ordered 2 years ago, so jobless or not i am financially able to put out some money to get it done just do not have enough to pay a retainer at this time.

| I have a 5yr old child who carries his fathers name first last and middle. I want to change his last name to my last name I have a 9 yr old who has my last name. I was married in jan of 06 in Nov of 06 he decided to move back to ND the divorce was final at the beggining of this yr. Since he left he has not sent a birthday or christmas card gift anything has made no effort to visit has not made more then maybe 10 calls to the child in that time. He did not pay any child support until the divorce was final ordered at right around 200 a month I have maybe recieved 300 dollars if that since the divorce was final. He recently got out of jail after 20 months which he did have income because he had work release but since getting out he worked maybe 2 weeks then quit but not for a job just because he didnt want to work i would assume. I want my child to have the name that his family who takes care of him suports him and is there for him being me has. I want to know what I need to show the court to prove it is in his best interest to have his name changed and what my chance would likely be that i could get it changed

| I pay child support every month until my daughter graduates in May 2010. My daughter's birthday was yesterday and she rec. breast implants from her mother. I feel that morally this is wrong and irresponsible as a parent!!! Is there anything I can do legally. This just proves they do not need child support if they have money to throw around on plastic surgery in hard economic times!!!
