i need help. i was married when i was 18 and had a baby with my husband. we got divorced right after my daughter was born. and my ex-husband didnt put his name on the paper work for the birth certificate. and he never sent it off to be filed either. i dont know if he is the actual father of my daughter but he has visitation rights from the divorce and custody thing. he has only seen her 5 times since she was born. i dont know what to do. do i legaly have to put his name on the birth certificate or can i leave it blank or put unknown in the spot where the fathers name goes. i havnt been able to get ahold of him to see what he wants to do so i am seeking any information on what is and isnt allowed in this situation. it has been a year since the birth of my daughter that is why i am wondering what is and isnt allowed in this situation. do i have to put his name down at all.

What is the name of your state (only U.S. law)? MI

I am asking this for a friend of the family.

Mom left dad and kids in AR- waited five years and filed for divorce in MI. Minimal contact with the children during those five years. Children are 13-12 and 9 now.

While in court for the divorce, the dad asked the judge, "What happens if she does not return the kids".. judge said then you contact your lawyer. Judge also stated that any future custody disputes would have to be filed in AR, where the children reside.

Mom called dad this year near the end of her 6 weeks and asked if they could stay a couple weeks longer, dad said yes they can.

Mom called dad yesterday and said she is not returning the children and that she appealed the courts decision and he would get his papers on Monday. Then said she is returning the youngest, but not the others.

Mom sent a text today telling dad he should have been in court the day she went over custody if he wanted rights. Inferring she has been to court since the last court order. This is the first he has heard of this, never served or anything.. not even sure she is being honest about it either.

Court order for divorce dated June 2008-

custody/jurisdiction

Names of children and dates of birth- all children of this marriage. Court acknowledges it does not have jurisdiction of these children since they have lived in Arkansas for several years, and still reside there.

Parenting time.

Parties have agreed to allow six weeks of parenting time with plaintiff (mom) every summer.

Then later in the agreement it says that court maintains jurisdiction to enforce this order and should either party cause legal action the one found in default will be held responsible for all legal and attorney fees incurred.


I told him to contact the courts first thing tomorrow to see if there is in fact a custody order for his children there.

Where does he go after that, does he file here for contempt, does he file in MI. Does he need to file an ex-parte for the return of the children with a motion to show cause?

School starts the 19th- children have attended school here all their life.

What is the name of your state (only U.S. law)? AR

I just picked up son, his dad sent him via a relative to TN and I drove to pick him up there. Dad did not sign and send back the new parenting plan that we had discussed. He is not willing to sign it now. He wants us to just "work it out" and he does not want me filing for child support and wants me to drop his current support order of 18.00 per month.

So I have all three children, here in AR, original orders are out of TN, none of the parties reside in TN any longer and have not since May of 2008. Current orders were signed in TN Feb 2009. Dad had relocated the children from TN to IL without proper notice or approval and I filed for modification. So that stopped the clock on IL residency for the children while in IL. It has not been 6 months since the last orders by TN.

My current orders give me residential on the two that came here in Feb.09 and dad has residential of son, who is now here as well. My concern is dad can just come get son at will if he gets mad at me.

How do I secure custody of son that I just picked up?

My son and his wife are divorced and she has custody. The mother does not want to retain custody of the oldest child and my son is unable to care for him. Both parents are not responsible and spend time back and forth in jail or in some kind of trouble. Their 12 yr old son wants to live with me, his grandmother. I can't afford to go through an attorney at this point in time. What can I do to get custody or guardianship. I pay child support every month until my daughter graduates in May 2010. My daughter's birthday was yesterday and she rec. breast implants from her mother. I feel that morally this is wrong and irresponsible as a parent!!! Is there anything I can do legally. This just proves they do not need child support if they have money to throw around on plastic surgery in hard economic times!!!
