Fraudulent Account |
| Divorce, Separation & Annulment |
| Alabama - I received a collection notice in the mail from a company that represents a hospital that me ex-wife takes our children to. We have been divorced for two years. Our divorce agreement states that she is to pay for the health insurance for our children. Any medical expenses not covered by insurance is to be split 50/50 between me and her. She is to pay the expense and then send me a statement/request for reimbursement. The collection notice refers to a bill/statement from a hospital that has the account in my name with our old address. The bill/statement is for treatment back in April 2009. My ex-wife obviously set this account up with this hospital under my name without my notice or approval. This is a fraudulent act. What is my legal recourse? Can I press charges against her?

What Is The Right Thing To Do? |
| Child Custody & Visitation |
| What is the name of your state (only U.S. law)? Alabama My former wife got sick and was admitted to the hospital where she has been for over a week. Her husband that she is married to now has a hitory of drug abuse and being violent. I just found out about my former wife being in the hospital from my son. I dont want my son to be in this mans custody and care why my former wife is in the hospital. My question is can I legaly with the law being on my side in family court refuse to allow my 2 year old son to go back with the step father if my former wife is not there at visitation exchanges regardless whether she is in the hospital or not? My concerns are merely my sons safety nothing else. My parenting plan has nothing in it for this. I dont want to be charged with non custodial kidnapping and breaking a law also.

Is Digital Video From Library Admissible in Court |
| Child Custody & Visitation |
| What is the name of your state (only U.S. law)? Alabama My former wife is not bringing our kids for court ordered visitation. Last Friday she failed to show up I called her and she refused to bring our kids. I know that instead of bringing children at the apointed date and time she was at the county library instead checking out books. I have now moved for a contempt of court action and filed it with the court. The county librarian has told me that there is digital video stored on the internet with her being there at that date and time. (I know I can subpoena the video but my quesion is if it is admissible or not? ) ( Do I need to subpoena the Librarian that is in charge of the digital video security system as well to testify about video?) What is the proper procedure for this if anyone knows Kindest Regards, Brian Oriley

Can I make my ex-husband pay 1/2 of my sons orthodontics? |
| Child Support |
Hi,
I live in Alabama and I am wondering if I can make my ex-husband pay for 1/2 of my sons braces.
My childs dentist has referred him to an orthodontist for braces because he says that my sons teeth are severely crooked (which they are) and the extent of the problem is going to cause tooth decay. The dentist says that the braces are needed due to save his teeth.
My divorce decree reads that we each are to pay 1/2 of any necessary, reasonable and ordinary dental expenses. Will this be covered beings that the dentist deems this necessary and has given us a referral?

Child abandonment and adoption |
| Adoption |
| I am trying to adopt a child by private adoption. The mother has already signed her rights away. I am having trouble with the father. He does not want the child, he just does not want his other children to find out about the baby. I have had the child for 3 weeks, and the mother nor father has bought anything but 1 bottle and 1 oneies for her. She has never stayed with the mother. Only stayed with myself, my mother, and my neighbor. Is it possible that I can get the parents for abandonment and then do the adoption? What is the name of your state (only U.S. law)?

endangering my child. |
| Child Custody & Visitation |
What is the name of your state (only U.S. law)? AL If I had information (obtained by illegal means (recording)) of my wife making drug deals, having an affair, and spending nights at other men's homes, how can I use it?
I have recently retained an attorney for $2,500. He has been paid over a week ago now and has not filed the divorce papers with the court. He claims we will be seeking a temporary custody order. I want her away from the kids. She even took them with her one time to get the drugs!! They are 5 and 6.
I want to get them out of the state and take them to my Father's home where they will be safe. My attorney told me that would not be very wize since I am seeking custody and the courts would frown on it. I dont want to wait and then something happen to one of the kids...
The problem is the means in which I get this information.
Please help. What is the name of your state (only U.S. law)?

Annulment/Divorce? |
| Divorce, Separation & Annulment |
Question about a lady friend who was married at a courthouse in AL, but resided in MS.
What's the cheapest and easiest way to handle her getting an annulment or divorce. Here are the facts:
- She's been married for three years.
- He slept with another woman 6 days after they were married.
- They tried to work things out, but it didn't work.
- They had no children.
- They've been separated for a little more than 2 years.
- He had no intention to remain faithful, didn't work, and was physically abusive with a few police reports... while she always had a job.
- And a good one from Wikipedia: "One partner had been deceived by the other in order to obtain consent, and if the partner had been aware of the truth, would not have consented to marry."
And just outta curiosity... if she got an annulment thru a Catholic church, would she still have to go thru the "legal" proceedings as well.

I will also be getting statements from the consular at DDs school that she speaks to, 2 other teachers, 2 girl scout leaders, and one friend.
I want to get a letter from her pedi showing how bad smoking is around children. I would love for it to be in the order that mom/dad can not smoke in the residence or car that the child is in, either can anyone else in the residence. Mom smokes ALOT around DD. I know it might sound petty to some, but 2nd hand smoking is bad for everyone especially children.

infant visitation |
| Child Custody & Visitation |
| My son is 16 and his girlfiriend is pregnant. He has told her he will stick by her and wants to have be involved in the baby's life. He has gotten a job and is saving every penny of his money. The problem is she says that the baby can not come to our house until he is 6 months old and then she will have to come with him. I know that she is going to breast feed and is going to go back to school in January (baby due Oct. 7th) so I am guessing she will have to pump (however she says she is not) the baby will go to daycare. We are in the process of looking for a good lawyer but I was just wondering if anyone has had any info on this. How does a judge unsually grant visitation in this situation. We want the baby as much as possible but again want to be realistic. We also want to ask the judge for the baby to have his last name. What are the chances of that. My son is well prepared to pay child support. Her parents have said that they do not want any money but he has told them that he would not be that guy that runs away from his responsiblity. Even though I am dissapointed in the situation I am pround of how he is handling it.
