I am writing a letter to my judge for a crime I was sentenced on 6 years ago to ask for a reduction in class in accordance with utah state law 76-3-402 [url=http://www.le.utah.gov/UtahCode/getCodeSection?code=76-3-402]Utah Code[/url] --- It sounds like I need to send a copy of the letter to the prosecuting attorney as well, how do I find out who that is? I was thinking of calling the judge's Aid or secretary and asking her, is that the best/easiest way to go about that? Any one have any thought on this process that might help out?

I am having a very difficult time finding gainful employment and am going to write a letter to the judge asking to reduce my felony to a misdemeanor and explain the reasoning on why I deserve that. I was sentenced in 2004 and have successfully completed probation.
I have been doing research and found Utah law 76-3-402 [url=http://www.le.utah.gov/UtahCode/getCodeSection?code=76-3-402]Utah Code[/url] that makes it sound like this is possible in Utah. Do I need to motion for this to happen in the letter or just request it (and copy prosecuting attorney w/letter)? I also found a website [url=http://www.recordgone.com/utah_reduce_conviction.htm]Utah conviction Reduction - Reduce Your Utah Felony to a Misdemeanor - Recordgone.com[/url] that states they will do it for $900, but I was thinking I could do just as good since I really don't have money to spend on a lawyer right now.
Is there a specific format I need to use when writing the judge? Thanks for help anyone can give!

My Grandson(17 year old college student at Utah State) received a citation in Logan, Utah for MIP. He blew a .002, which I guess qualifies for the MIP in zero tolerance states. He states that he had not been even sipping a beer. We are prepared to hire a lawyer for our Grandson to fight the charge. My Grandson has witnesses who will verify that he did not drink including his girlfriend who was with him the entire day(as well as several days and nights prior to the evening in question). Should we proceed? I mean two one-thousands of a per cent. Are the breathalyzers even accurate to that degree? Thank you.
