I got a DWI 3 years ago and never renewed my license after it was suspended. Do I still have to pay the $1000 a year surcharge, even if I haven't had a DL since my conviction? Will I have to pay the $3000 no matter what? Or does the surcharge go away after 3 years of my conviction?

Due to an incident that occurred last evening I'm left wondering if my rights have been violated. Are we really free range for the police to search in this country? Do I have no right to privacy?

So to explain this properly I suppose I should explain what led to the stop. About 11:30p I was having trouble sleeping and I decided to go for a bike ride. I live in an urban neighborhood area with a mixed population (mostly well off but some poor). Although it was an odd hour for a bike ride (and some might say downright dangerous) I must point out that I had no ill intent and have never been arrested in my life.

At about 12:30a after riding down one particular street about 2 miles I decided to turn back and go home. Overall I was going rather slow and taking it easy just minding my own business and staying away from cars and the occasional street walker. I noticed a van coming up behind me and to get out of the way I pulled into a parking lot. To my surprise the van followed me, I swerved because I thought they were trying to mess with me or hit me with the vehicle. They swerved with me. I basically stopped and looked back to see what they wanted since I was pretty much cornered and two men jumped out of the van (an unmarked vehicle) one yelling at me to put my hands on the hood the other yelling at me to put my hands in the air and to throw my bike down. I could make out a police vest and I did as instructed, put the bike down and put my hands in the air (can't remember if they had pulled their gun or other weapon). They proceeded to frisk me, patting down my clothing to find whatever. While patting me down they were asking me "what are you doing here", I responded I was out for a bike ride. They asked where I lived, I told them. One of them reached into my left pocket and pulled out my keys, asked if they were my keys, I said "yes", he proceeded to ask "where is your car?" I responded that it was at my apt. The other cop reached into my right pocket and pulled out two pieces of mail I had pulled from my mailbox before leaving my apt complex. Both pieces of mail were financial statements on my auto loan. They asked "who's address is this", I told them that's where I live. Not believing my story they asked for ID, of course this is the one time I don't have it on me. They tell me it's OK to put my hands down and one gets back in the car with my mail to call in my address information to see if it was me.

The situation dragged on for about 20-30 minutes while they verified my information, questioned where I worked and my date of birth. After they were finally convinced I was of no harm they let me go, but I was never given a reason as to why I was stopped. They tried lecturing me on how it was a dangerous area to ride at night and that I didn't fit the profile to be out on the street this late. I'm 28 years old by the way, and I pay taxes to use the public streets???

Not that I want to file a complaint with the city but more because I want to know my rights for the future. Does this sound like a legal stop? Did they have the right to go past patting me down? I mean did they really have the right to take my keys, mail or other belongings out of my pockets or off my persons without my consent?

It just doesn't seem right and I don't feel I live in a free country as some might say...What is the name of your state (only U.S. law)?

I was at my friends apartment we were up all night and i went outside, fell, and got a concussion...my head was bleeding. There was a cop nearby and saw. After that all i remember was paramedics checking me out and then i remember the cops saying i was drunk and trying to give me a ticket. I kept telling them to give me a breathalyzer to prove i was intoxicated and he refused and told me to go buy one. I refused to sign the ticket and they told me i had to sign it or go to jail, so i signed it. So my question is should i fight it in court? if not, what should i plead?

My wife was recently sued in Illinois by a funeral home using a document on which someone had forged her signature. The original contract was with her step-father but she is executor of her mother's estate. Someone, either at the funeral home or at the attorney's office, forged my wife's first initial and last name onto a copy of the estimate of charges, which was with her step-father, evidently using a letter she had written to them from which to copy. We live in Texas and she did not appear in the Illinois court to answer a fraudulent suit, thus a judgement was entered against her. I am trying to convince her to press charges. Since she is a Texas resident and the funeral home is in Illinois, it would seem to me that this would be a Federal case. Should she contact Federal authorities or Illinois authorities to press charges against the funeral home director? We believe the attorney may also be involved. We have paid the funeral home more than $1,300 over and above the cost of the funeral but the attorney is trying to collect his fee and additional interest on the basis of the judgement. My wife owns no property and has no assets in Illinois, but she is a beneficiary to her mother's will, which includes a home and farm which are owned by a trust her mother set up many years ago. We could pay the fee but are livid that they would use a forged contract to file the suit in the first place. What are our options as far as pressing charges for the forgery and fraud?

My 15 year old ran away with her 18 year old boyfriend. they were gone for 2 weeks. We reported her as a runaway on the first day. After 11 days the cops said they had enough evidence to issue warrant for his arrest at this point which was a thursday night. We were told that the warrant would be issued on Friday. Well on Sunday night my daughter returned home. The police said they could still arrest him for harboring a runaway and he left the state with her. We were told the judge never signed the warrant on friday but that could still happen on Monday. Now a week later we are being told that we can not do anything because she went with him willingly. Is this correct and if the police won't help what is our next step. The reason we want the charges filed is because the boy is still around, going up to her school etc. and we are afraid if we do not press some kind of charges, they will do it again.

Back in 1984 I was sentenced to 3 10 year sentences to run concurrent. I was released 6 months later on Shock probation. 1989 I screwed up again in PA and was sentence to 2 to 4 years. I was released in 1992 on parole in PA. Walked off the 2 years without hearing a word from Texas. Asked my PO and he said that Texas didn't want me back and that was the end of that, so I thought.

I received a letter from Bell County telling me that I am in Violation.

Any Ideas?
