PA Legal QuestionI need advice. I am scared. Please.

Pennsylvania is my state. I am not sure how to go about posting my question.... so I'll just try now. I have already once been before a magistrate for a summary on shoplifting. I have just got caught once again ( shame on me-I'm furious at myself) and will be in front of the same magistrate as the first time. So, this is my second offfense and I would like to know any information that will apply to me and what is going to happen to me with the law. It's greatly appreciated - any comments at all. Thank you.

I recently received a citation for underage drinking, but i did not blow into the breathalyzer so there is no real proof that i was drinking. How should i approach this case?

(Pennsylvania Only U.S law)- My son was outside playing when he began walking up and down the street rapping what he said to be gibberish. There was 2 ladies outside one that called the cops and one that said my son was not doing anything wrong. Before the 1 lady called the police she went over to her neighbor across the street and when my son was by the neighbors house they approached my son and the Neighbor began cursing at my son telling him to stay off his street. The neighbor said he cursed at her telling her dog to "Shut the F*** up" and saying he said "Pop Pop Pop im shoot up the house" There was other things written down on the citation but I cannot make out what it says. Also my son was taken in a police car and his rights were not read to him. Also he's being charged with Disorderly Conduct-Unreasonable Noise & Harassment-Course of Conduct W/no legit purpose any advice or anything you see wrong will be strongly appreciated Thank you

So i posted here the other day to get legal advice about a 1st degree retail theft .. but! i called the store as if i was a ustomer and got prices on all the things that i had taken realizing it was only 93$ in merchandise i called the store and talked to the secret shopper mel and asked him about it he told me it was legal for him to charge me the retail price although the items were on sale questioning that idea i called the cop who had arrested me and left him a message he never called me back so today i call and found out that it was dropped to a summary offense... kohls tried to dupe me ..nice try but anyways now what am i facing and also do you think i could sue kohls for this and do you think i could get the charges dropped it i threatened to call the local news or something not that threatning is legal and i would do it in a very civil manner of course .. thanks for you help sorry i dont use punctuation

PENNSYLVANIA- I was caught at a kohls shoplifting $180 [retail price [93.34 sale price] i am charged with a 1st degree retail theft i had my son wth me but an not being given any endangerment charges or anything i have priors as a youth including larceny when i was like 16 i am 21 now this was just an assanine thing i did randomly i dont know why i did it but i wouls like to know if someone should tell me what i can do to help myself here ihave 2 kids 3 months and 18 months and i work part-time and am living with my partner i definately dont want to go to jail for this and i really dont even want probation since i am in an abusive relationship and if i needed to leave being on probation would enable me concidering i have no family in this state and woud have to go out of state i am supposed to go in front of the judge tomorrow the guy who caught me showed the cop some fottage and said he saw me putting things into the diaper bag but i didnt get to se the footage and i dont see how he would have any because i was in a dressing room when i took the stuff wich makes me think there may be cameras in the dressing rooms... please help me

I am from Pennsylvania and have a question regarding the questioning of students by School Faculty. Brief background on situation:

Son was at a party on a weekend which was also attended by the State Police later on in the night. No citations where given at the party, nor have they been received one week later. Potentially soon as they wrap up investigation. The legal side is still up in the air.

School Faculty over the past week has been pulling kids out of the hall and bringing them into a room with 3-4 Faculty (Super, Princ, Vice Princ and/or Athletic Director). So 3 or 4 adults on 1 student (ages 16-18). They were questioned about this activity that occured on the weekend and off-school property, not only about thier participation, but others as well.

After discussing with my son and others, it is pretty consistent that all felt intimidated as they were pressured to answer about others or themself. Having 3-4 male adults, 2 of which are known to be of a bullying nature, pushing for answers to incriminate them and others.

NONE had the option to contact parent and/or legal council, nor where they read any rights, nor knew of them. They were just plucked from the hallway and in questioning for 5-20 minutes. I realize Miranda is not neccessarily applicable, but isn't the activity that I describe at least improper if not illegal? Are our Schools not self contained investigators, police, judge and jury?

All this was done to determine who was to be suspended from various programs, groups and sports teams as part of their policy.

Question is, do I or other parents have any legal grounds in addressing this tribunal atmosphere with our kids?

Hi! I was offered a sales position at a life insurance company in NJ.

I signed all the paper work and started to schedule classes to study and get my license required to sale insurance.

Before offering me the job I was called back for 3 interviews. After the first interview I was asked to complete a required information questionnaire.

One of the questions was whether I was ever been convicted of a crime. I answered truthfully about my summary offense for retail theft in PA.

Several hours after signing a contact with them, I received a call from them regarding my criminal background and told me that my employment was on hold. I was not very happy about this. I knew my record would make it harder for me to get a job, but this was just unnecessarily cruel.

Several days after the call, I was inform that I will not be working for them.

One week later, I received a letter in the mail by them. The company that the insurance company hires to do the background checks require the insurance company to send the background check information to me.

What I found was surprising. There are no arrest records and my background is clear. They did a search in county where the crime was committed and it says "no record found".

I am baffled. I'm pretty sure I didn't dream of getting caught, taken to the police station and finger-printed.

The only thing I can think of why this happened is the timing. The background was checked two months after the crime happened.

Anyone have any clue what the heck happened here?

19 year old college student was at a party left that party and went to a Frat where a friend lives and party was in progress. Upon attempting to enter he was "pushed" by the door monitor as a police cruiser was passing by. He was given a breathalyzer test - positive but not sure of the level. Incident was off campus. He received a letter charging him with Title 18 Section 6308 and also trespassing. Total fines $700 - $400 for DUA and $300 for trespassing.

I thought the limit for first offense DUA was $0-$300. Why or how could they charge $400 and how could he get amount dropped without legal counsel? Does it depend on the alcohol level?

RE: Trespassing charge - Can they charge him with this if he did not enter the building? Would this have been charged by the officer or does it require the owner of the residence to file it? Would the Frat have filed it to take the burden of proving they did not supply the alcohol?

PA Legal Questionyour experience with ignition interlock device
Drunk Driving / DUI / DWI
I wanted to get some feedback on people's experiences with driving with the ignition interlocking device. I know that I need it installed if I want to drive. Not a problem. The issue is the rate/process at which the device tests and possible potential for failing attempts regardless of alcohol consumption. Please understand I am not trying to get around it. I want the damn thing if I drive, but things have been very easy with public transit and I may do another year without the ability to drive. I would not have to pay the fee for the device (1,000$), would be safe, and would not be a potential repeat offender as police can still arrest you for DUI outside of your vehicle.

Thoughts & experiences are appreciated. I have about 10 days before my notice comes in the mail.
