<description>My fiance was charged in ohio last week and is serving 6 months. 6 years ago he had a charge in West Virginia. I looked up his DOC number, and his offender information cameup. and his status is &quot;paroled to other state&quot; meaning he has no parole officer in WV. He has one in Ohio for that charge. But WV is trying to revoke his parole. And my friend who has delt with these kind of sitsuations told me they CANNOT do that and that if they try and do, we can take them to court for double jeopardy because he is not paroled in WV, he is in Ohio. and it is up to his Ohio parole officer whether or not they revoke his parole. But he already had his sentencing court date. He was giving 6 months. I am wondering how the laws work on that and if indeed WV cannot touch him.

  <title>MIP in Michigan at MSU</title>

<description>We live in Ohio, child was at MSU in E. Lansing MI. Received MIP. He is almost 19 yrs. old. If it was a campus police that issued the MIP, what jurisdiction will hear the case? I know we can request the diversion program. Do we request it at the first hearing, or plead not guilty then go to pretrial and request the diversion program. Also he goes to school in another city. Is having to call in daily to see if your number is the one to go conduct a breathalyzer standard? Is this something we can organize with the town he goes to school at. It is a couple hours from E. Lansing. This is our first trip down this road and just want to have everything lined up. Also, is an attorney recommended? Our concern is if he resides out of state except for being at school, will there be differrent penalties? I've read never plead guilty, but then you have to plead guilty to request diversion. At what appearance do you request the diversion program? Any advice will be greatly appreciated.

<description>My daughter has been charged with a fourth degree misdemeanor, unlawful use of property. We have never been in court before. Do I have to have a lawyer? Can she plead no contest and take her punishment? Will the prosecutor rake her over the coals? I don't know what to expect and would like to be prepared.

<description>OHIO: In Ohio how long can a defendant be held in jail before a trial. What are the States guidelines for the amount of time before arraignment. After arraignment how long can a defendant be held in custody before a trial or a plea bargain. I am asking for basic information on the states obligations to move a case along in a timely manner. The defendant can not make bail.

<description>My Fiance is on Parole in Wisconsin and in West Virginia. We live in Ohio. Last year he was in a bar where there were underage girls drinking. And of course lying about their age. My fiance was not aware they were underage. And got a felony 4. He took a plea in Ohio that was 6 months ran concurrent with his parole violations in Wisconsin, and in West Virginia. Wisconsin does not want to revoke his parole. But West virginia is taking their time on making their decision. I told told that West Virginia has up to 90 days from the time of his sentencing in Ohio to make their decision. I'm not sure if its true or not. That is what I am wondering. Also I need to know the laws on interstate compact for ohio and west virginia. So that along with the amount of time West virginia has to make their decision on whether or not they are going to revoke his parole or not.

<title>First time Possession of Marijuana in Ohio</title>
  <link>http://www.elprime.com/tracker/subscribe.htm?435670.001</link>
  <pubDate>Mon, 20 Oct 2008 20:51:00 -0600</pubDate>
  <category>Drug Charges</category>
<description>Ok so here's the story. A couple nights ago, I decided to get some marijuana off a friend (3.5 grams). When my friend went to his car to get it, a police officer drove by and most likely saw what was going to happen, because he later then pulled me over down the street. He pulled me over because he said I had a loud muffler. He then told me to roll my windows up and sit in the car and surprisingly he brought out the K9, he had the dog sniff around my car a couple times and then the officer asked me if I had smoked in the vehicle before. I was honest and told him I have, then he proceeded to ask me if I had anything in the vehicle that he should know about. I then just confessed and told him I had some marijuana in the center console. I gave it to him and then he came back and wrote me a ticket for possession of marijuana and excessive noise due to a loud muffler. I asked him if I was going to jail because of this (hey, I had no idea what to do, this was my first time ever getting caught). He then told me I wasn't and that this was pretty much just a traffic ticket. He told me that this shouldn't effect my job or anything school wise.

Today I called the police station/mayors court to find out how much my fines were and they told me that the fine for the marijuana charge was $240 and the loud muffler was $130, so all together i would be paying $370.

I was told by the lady on the phone that I could have gotten my license suspended if it was under state code but the box was checked for &quot;city ordinance&quot; so I won't be looking at any jail time or license suspension.

Now this happened on the 18th and the court date or when I have to pay the fine is for the 23rd. The lady on the phone told me that I could get an extension until possibly the 20th of November. She also said that they would have to add $10 if I received an extension.

My question is, will this be showing up on any background checks of some sort? I have researched on this forum that it will not and I have also heard that it will show up. I have about 1 more semester left in school and I will have to find an internship also for the degree I am currently pursuing. My main worries is will this effect my job search in any way? Also, does anyone know the details on requesting an extension for the fines? I have quite a clean record, only 2 points on my license due to a speeding ticket, and some other tickets for no front license plate and a noise violation due to my stereo system.

I think I would say I am pretty lucky because I guess it could have been worse but I really have learned my lesson and I do plan on quitting smoking marijuana after this incident. Can anyone give me advice?

Thanks.
