We live in Ohio, child was at MSU in E. Lansing MI. Received MIP. He is almost 19 yrs. old. If it was a campus police that issued the MIP, what jurisdiction will hear the case? I know we can request the diversion program. Do we request it at the first hearing, or plead not guilty then go to pretrial and request the diversion program. Also he goes to school in another city. Is having to call in daily to see if your number is the one to go conduct a breathalyzer standard? Is this something we can organize with the town he goes to school at. It is a couple hours from E. Lansing. This is our first trip down this road and just want to have everything lined up. Also, is an attorney recommended? Our concern is if he resides out of state except for being at school, will there be differrent penalties? I've read never plead guilty, but then you have to plead guilty to request diversion. At what appearance do you request the diversion program? Any advice will be greatly appreciated.

Last night I was walking with some friends about a block from home without a shirt on a public sidewalk. I rarely wear shirts in outdoor public places and have had police officers joke with me about it in the past. This time, a police officer told me I needed to put a shirt on. I thought he was joking (this happens a lot) and kept walking. He ran up, stopped me, and reiterated. I didn't have a shirt with me, but was given one by someone else. I began to put the shirt on. The shirt was a little too small and was taking me a bit longer to put on than it would have otherwise. The officer told me I needed to hurry up. Once I had it most of the way on, and was about to pull the last part over my stomach (it took maybe 10-20 seconds total), he instructed me to put my hands behind my back and handcuffed me. I was told I was being arrested for indecent exposure. I was driven to the station by a different officer and upon arrival at the station I was told that I was being cited for drunk in public and I could pay the fine, pay a bail bondsman, or go to jail. I was obviously not drunk, but had been surrounded by drunk people as the bars had just closed and everyone was leaving.

Is there anything I can do other than pay the fine or pay a lawyer? I am a poor college student, and I don't see how I have done anything wrong or broken any laws.

Grounds for lawsuit?

Hey: In June 2007, I was sentenced to a 3 year Non-adjudicated probationary period for Felony False Pretense by uttering a bad check in a closed account. I pled guilty for the plea bargain that I just mentioned in this message. My original release date off of probation was to be around June/July of 2010. However, because of good behavior, and this being my first offense, my probation officer decided to discharge me off of probation in January of this year. I have supporting documents from the courts that my case was dismissed and my charges were dropped. The bad part for me is: I am DILIGENTLY looking for employment. I have professional experience, but that doesn't matter when a potential employer checks your criminal background and see where you've been arrested/charged with a crime of theft. My problem with finding a job is this: it was told to me by my attorney at the time of my court appearance that I will be sentenced to a "Non-Adjudicated" type probation. Meaning that unless I violate the terms of my probation, nothing should show of my criminal background history. However, it is showing up, I have documentation from a background check company that my charges are on my background. I know this may sound silly, but I really am thinking of filiing a lawsuit against my state (Mississippi) because for one: I still have a court fine to pay, but am unable to gain employment ANYWHERE. This includes an application that I had with Captain D's. Almost all companies perform background checks on potential employees. I feel I have a case because it was written even in the court papers and on my probationary papers that I was on "Non-Adjudication", and I have not violated ANY terms of my probation- I NEVER served time in jail, nor was I ever convicted of the crime. In fact, it shows where I have been released off of probation by the courts, and that my case was dismissed- I want to file the lawsuit on the grounds of what is really on my criminal background, and the problems I am facing as far as employment. Has anyone ever had a problem similar to this? And if so, how did you handle it!

Thanks!

PS: The courts told me I MAY could get this criminal background expunged. But I feel I shouldn't have to pay for ANYTHING to be removed because it was told to me that the charges wouldn't even show up! How would they expect me to pay for an expungement when I can't even get hired anywhere? What should I do?!?!?!?!?
