Illegal Stop? |
| Arrests, Searches, Warrants & Procedure |
Hello,
I've been stopped in Maine by two different Maine State Police Officers in a very short amount of time. The reason for stopping me was simply because the registered owner of the vehicle does not have a license and I apparently fit the description of the registered owner.
The registered owner is a 60 year old female and I'm a 31 year old female. It would have been impossible for The Maine State Police, being the trained observers that they are, to have made the mistake that I was the registered owner of the vehicle if they simply glanced over at me.
Is seeing that a 31 year old female driving a vehicle registered to a 60 year old female who doesn't have a license enough reasonable suspicion to make a stop?
The reason why this matters is because I could theoretically be pulled over again and again and again, for no reason other than fitting the description of the owner... But the fact is I do not fit the description of the owner. Therefore, I believe there was no reason to stop me.
This also matters because I was arrested by the second Maine State Police Officer for not having a drivers license myself. The police officers didn't stop me because they knew I didn't have a license, but because they knew the owner didn't have a license. The first police officer let me go because I wasn't the owner and he didn't run my license.
If the stop is deemed an illegal stop then could I possibly win a motion to suppress the evidence? I also received a ticket for not having insurance. I won't be hiring a lawyer, so I'm going to have to do this myself. The lawyer is going to cost more than what I believe I'll be paying if I lose, so why try to win with their help?
Any help is appreciated.
Thank you.
