MA Legal QuestionCan Police Rat out a Rat?
Drug Charges
Hi,
Im a 22 year old from western massachusetts. I was recently arrested with a bag of cocaine on me and around 900 dollars so they are trying to charge me with selling. Im not so worried about my punishment as much as what is going to happen in court. While arrested I was scared into talking, I told them i wanted an attorney before I talked to them but they informed me that that was a bad idea and I should talk to them first or I would be in a cell for up to a year waiting for trial, I had never been arrested before and just didn't know. I was arrested with three friends who were actually let go instead of arrested. One or all of them must have told the police who i bought my stuff from because the cops knew his name and even where I go to meet him. The cops got me to tell them a few bits of info, they showed me a picture and I ID'ed my dealer. The cops wanted me to call them and set the guy up a week later. I never ended up calling the police after i was released tho, I live in an apartment complex with my mother and am afraid of retaliation. Now while being questioned the cops told me whatever I said to them COULD NOT INCRIMINATE MYSELF. So what I want to know is.... when I goto court will my mistake come back to haunt me? Im scared that the police will tell the court that I ratted out my dealer to get me to testify to that or use the fact that I told them I purchase over 700 dollars of cocaine off him every few days to convict me of distribution even tho they told me what i told them would stay in that room Im afraid because now that I won't help them bust the dealer they might use info from that conversation in court.
I was also wondering, since I told the police, "I think I want an attorney" and they advised me against it would that be a reason to get what I told them thrown out and when police say, "What you tell us now will stay between us" or "What you tell us can't incriminate you" are they being honest or was that just lies to get me to talk?
I know if they tell the court that i ratted me and my mother could be in bad trouble on the street and if I helped them bust someone which I won't we would be in even worse. I just need to know, will they use what i said to detectives during questioning or are there laws to protect me? Sorry for being so talkative but im very very worried. I made a huge mistake and even tho I can't take it back I also can't go through with helping the police bust someone and I think because of that they will take what I said and hurt me with my own words.

Thanks,
C.B.

MA Legal QuestionQuestion about notification of criminal complaint
Arrests, Searches, Warrants & Procedure
A friend of mine was notified that an application for a criminal complaint was issued against him. The form clearly states that he has not been arrested, but also says:
"WARRANT is requested because prosecutor represents that accused may not appear unless arrested".
What does this mean? Is there a warrant for his arrest?

MA Legal Questionfemale girl stalked/harassed by male student
Juvenile Law
My daughter is being harassed/stalked and stared at by another student since February 2009. Now they have moved on to another school and the student is doing his usual staring. I had sent a letter to this school request the boy have no classes with my daughter. The school has put him in the same lunch. He stares at my her, tells other students he knows her scent, he says he's "waiting" for her. He follows closely to her. Other students are aware of this situation and my daughter has gone to the Vice Principal for two weeks now. They are trying to talk to the boy...asking him how ths makes my daughter feel and giving him advice to take another stairway or to look another way when he is eating his lunch. Thsi is very upsetting to my daughter. She feels uncomfortable and hides behind other students when he is staring at her. What are my rights as a parent? What are my daughter's rights? What steps should I take to end this harassment?

MA Legal QuestionVictim's property searched
Drug Charges
I friend of mine had his apartment broken into and had a small safe and an Lcd tv stolen. His neighbor witnessed the incident and positively identified the downstairs neighbor as the burglar. The police got a warrant for the downstairs neighbor's arrest and a warrant to search the house where he was staying. He was caught red-handed with the tv and the safe and he was arrested, he also was just released from prison for another armed robbery 5yrs ago. My friend (the victim), we will say he is an unlicensed street pharmacist. I'm sure when arrested the thief must have informed the police about his unlicensed business in an effort to save himself. The safe that was stolen was held as evidence for the robbery charge. The police called my friend and asked him to open the safe, which he of course refused to do. The detective showed up at his house the other day and told my friend that they had opened the safe which contained a few different types of pharmaceuticals, only a couple of each, maybe 3 types, and 2 dime bags of weed, plus $6500 cash (it really was $11,000 but the DT says $6500 I'm sure he went home a little heavy in the pockets that day). He informed my friend that there would be a summonds in the mail unless my friend wanted to "work" for him, which is absolutely out of the question. He still does not know if the DT had a warrant to open the safe, do they need a warrant to open the safe or can they just open it because they were given a tip by a criminal under arrest? The safe was a fireproof Honeywell safe that needed a key plus a 4-digit code to open so I assume it was cut open or a locksmith was used. He is NOT going to set anyone up so IF he goes to trial and they didn't have a warrant will it be an illegal search? If so no conviction means he gets his money back right? For what it's worth it was the 2 dimes, a finger scale, a few adderall, and 2 or 3 OC 80's. I've searched the internet high and low and couldn't find anything relating to searching a victim's property. Any advise?
