Can the polics search my car just because i locked my keys in my car? |
| Arrests, Searches, Warrants & Procedure |
| I was stopped a served with a restraining order and the police asked me to get out of my car. I got out and hit the lock button on my remote and threw the keys through my sunroof (which was cracked enough for the keys to fit) they handcuffed me and started asking me why i did that and i told them that i could. Then they asked me if i was drinking and started harassing me. They got done with that and they took the handcuffs off and let me go, one asked if i wanted them to open my car doors and i said no. I then walked off to my friends house across town and when i came back my car was gone. I knocked on the peoples door that my car was in front off and they didnt answer so i walked down the street and a sheriff officer pulled up and told me to get in. I asked him where was my car and he said the owners of the house i was parked in front of there house had called and had it towed since i was blocking their driveway. The sheriff tried to take me to the police station but i refused and told him to drop me off at the gas station. I called the tow yard and the owner said that he wasn't there but i could get my car in 30 mins. 20 mins later the sheriff's officer pulled up to the gas station and slammed me against the wall and arrested me for possession of marijuana. They had called the next county over to bring a drug dog in to run it around my car at a private impound yard and they broke into my car and got the marijuana. The owner of the tow yard said that he didnt give them permission to enter his property. My court appointed attorney wouldn't file any paper work fighting the search he said he was waiting on more info from the police and district attorney. Kingman Ks pop. 3500 these people see each other everyday. The officer stated that the reason why they called in the drug dog was because it was suspious that i locked my keys in my car. I ended up telling my attorney he was worthless and working for the D.A. ( which is true his other attorney in the firm is the part time prosecutor in town) and he quit so i'm lawyer less now. Another attorney told me that the search was illegal so now i'm wondering what i should do? Thank you very much.

Just about completely lost |
| Arrests, Searches, Warrants & Procedure |
| A friend of mine is currently awaiting court on a c felony theft charge. As I understand it the situation is this. A "friend" of his didn't have an ID and my friend pawned some items for him. Well the items were stolen and my friend got charges with the theft. When he was arrested he told them what happened and they let him out on bond. They arrested the "friend" and he pled to the theft (not sure if it was the same charge or not) and was sentenced to three yrs prison. Meanwhile in January 09 my friend's defense attny told him not to take the offer (5 yrs probation) because they have cases like this all the time and they will more than likely offer something better next time. So the last time he went to court (April 09) his attny told him to take the deal he doesn't have time to mess with this case anymore. My friend told him no and the case was re-set again to the end of June. The court is charging him with the felony theft and not with theft by receiving. All items in question were returned to their owners. And the amount received for the items is no where near the felony range. I understand that the cost of the items or replacing these items is how the charge is given, but doesn't the fact that all items were returned in same condition have anything to do with it? Now to complicate matters, while he was waiting for his June court date, it is still April, his attny apparently told the judge that he was ready to take the deal and said he would appear in court on the 20th or 27th of April. My friend was not aware of this and stupidly left the state for a while. No one contacted my friend about this new court date (he was still in Arkansas in April). This is what I find odd, he was in a car accident on one of his prior court dates and got about 6 calls from his bondsman asking where he was when he didn't show up for court. This time no one called before court to tell him and no one called on the court date. The judge issued a bench warrant (I think) and while he was out of state he was pulled over for a traffic stop and when his name was ran he was arrested. When he was returned to Arkansas the offer of probation was still there, he didn't want to take probation because of personal reasons and instead was going to ask for 3 yrs prison to get it over and done with. For some reason when he went to court to sign for the time the prosecutor rescinded the offer and is now wanting to give him ten years. My friend has a past that is not very good but isn't there something that can be used to help his case? I don't know what I am expecting but anything you could offer would be much appreciated.

Felony Adjudication |
| Drug Charges |
Kansas
I was adjudicated of a felony when I was a minor. Possession of Marijuana with the intent to sell to be exact. I have successfully completed my program and I was told two years after that I could expunge my juvenile record. My question is, once its expunged will I be able to vote and own a firearm?
Thank you very much for reading. Any advice is appreciated.

Lawful Search? |
| Arrests, Searches, Warrants & Procedure |
| I'm 17. My car was in the high school parking lot, there was an annonymous tip that there were drugs in my car. They had a drug dog come to the school. The dog hit on my car, which was unlocked. The police then searched my car, confiscated 1 gram of pot, called me out of school, showed me what they found, then arrested me. Is what they did legal?

Statute of Limitations |
| Juvenile Law |
I'm having trouble finding information on this, but maybe you all can help.
I'm 17 years old, and got caught up in a statutory rape situation when I was 16 early in the year. Long story short, her parents found out, and forced me to move to another town with other family members, otherwise she was going to press charges. Recently I started researching my situation again and read that the statute of limitations does not begin until I turn 18, so I could be charged until I am 23. Unless I become emancipated, which given the situation, my parents would be supporting in that decision. As a defendant, does anything change if I become emancipated? Can I be charged with the crime after I am legally an adult? Would this cause me to be charged as an adult?
