OVER LAST YEAR WE HAVE DRASTICALLY MADE CHANGES IN OUR LIVES IN AN EFFORT TO PROVIDE WHAT WE FELT AND OUR SON FELT WAS BEST, THE HARDER WE TRY THE WORSE IT GETS.....
HE HAS THREATENED TO MAKE UP FALSE ACCUSSATIONS AGAINST US EACH TIME HE DOESN'T GET HIS WAY SUCH AS PHYSICAL AND SEXUAL ABUSES STATING THAT POLICE WILL TAKE OUR CHILDREN AND PLACE IN FOSTER CARE,
HE IS ALWAYS POTRAYING HIMSELF AS THE VICTUM AND HAS AN EXCUSE FOR EVERYTHING THAT IS TOTALLY NON RELATED AND HAS CONVINCED HIMSELF HE IS RIGHT ABOUT EVERYTHING... HE MAKES CONSTANT ATTEMPTS TO PROVOKE US TO ANGER, HE HAS RAGES OF ANGER AND HAS SLAPPED OUR YOUNGER CHILDEREN, HE HAS BEATED THE DOORS TRYING TO GET AT US AS PARENTS WHEN WE TRY AN EXTIT THE SITUATION TO ALLOW HIM TO CALM DOWN,
TROUBLE IS THERE REALLY ISNT ANYTHING FOR HIM TO BE UPSET ABOUT, IT IS ALL PERCIEVED
NOW THAT IT IS GONE ON WE ARE DEALING WITH SIMPLE TO LARGER ISSUES WHERE WE ADDRESS A SITUATION AND WE ARE DEALT ONE OF THE FOLLOWING

WE HAVE TAKEN HIM TO EVERY MEDICAL TEST YOU CAN IMAGINE TO JUST BE GIVEN NORMAL READINGS, OUTSIDE FAMILY AND INFLUENCES ARE TRYING TO PURSUADE US TO GET HIM ON MEDICATION FOR ADHD, ADD AND ALL THAT ....
REALLY THE PROBLEM IS IN HIS HEART AND WE WANT TO LOVE HIM TO RESOLUTION AND HELP HIM
I CANNOT IMAGINE DEALING WITH THIS AT THE COST OF TRAUMITIZING OUR OTHER CHILDREN....
I HAVE LEARNED TO STAY CALM AND NON REACTIVE IN THESE OUTBURSTS AND SITUATOIONS TO QUICKLY DEFUSE THE SITUATION IN AN EFFORT TO RESOLVE
MY WIFE AND COLLEGE DAUGHTER, YELL BACK AND USE SARCASISM AND GENERALLY WORSEN THE SITUATION AND CREATE REACTIONS VERSUS RESOLUTIONS OR AT LEAST A PROCESS OF RESOLUTION...
WE HAVE RELOCATED IN THIS ECONOMY AND SUFFERED SEVERE LOSSES AND HARDSHIPS BY PRIORITIZING A TOP RANKED CHRISTIAN SCHOOL AND CHURCH IN SC, WHICH HE LOVES SOCIALLY, I AM COMMUTING 3 HOURS TO WORK WHILE SEEKING OPPORTUNITIES IN THE AREA AND LIVE IN FEAR WHILE I AM AWAY THAT SOMETHING WILL HAPPEN...MY INCOMES HAVE GONE FROM $185K PER YEAR TO SO FAR LESS THAN $20K PER YEAR DEALING WITH ALL THIS, AND WE ARE ON THE VERGE OF BK... ALL THATS OK, I ONLY CARE ABOUT THE WELL BEING OF MY SON AND MY FAMILY, MATERIAL THINGS CAN BE REPLACED, JUST STRIVING FOR BASIC NEEDS ...
I HAVE SOME QUESTIONS:
1-SHOULD MY WIFE AND I FOR THE PURPOSE OF PROTECTING THE CHILDREN GET A LEGAL SEPERATION OR DIVORCE AND ONE OF US TAKE HIM FOR A SEASON TO PROTECT THE OTHER FAMILY MEMBERS?
2- IF WE ARE IN SEPERATE HOMES AND SEPERATE STATES, AND I REMAIN WITH MY SON, IS THERE A TIME FRAME THAT NEEDS TO BE ESTABLISHED BEFORE THE OTHER FAMILY MEMBERS ARE EFFECTED, IN OTHER WORDS, WHEN CAN I CALL POLICE DURING AN OUTBURST TO WHERE OTHER CHILDREN ARE NOT INVOLVED AND CANNOT BE TAKEN FROM THE HOME NO MATTER WHAT MY SON CREATES?
3- IS THERE ANYTHING THE POLICE WILL EVEN DO TO MY SON? IT APPEARS ALL LAWS ARE IN FAVOUR OF THE CHILD AND THEY KNOW JUST WHAT TO SAY AND DO AND THE PARENTS AND FAMILY SUFFER BUT THERE IS NO CONSEQUENCE TO THE TEENAGER AT ALL? AT WHAT POINT SHOULD I INVOLVE AN AUTHORITY?
4- IN RESEARCHING I CANNOT FIND ANYWHERE THAT COULD BE AN OPTION, LIKE A MILLITARY ACADEMY OR PROGRAM TO SEND HIM, ONLY PRIVATE PLACES THAT COSTS ALOT AND MOST ARE FOR AFTER HIGH SCHOOL. HE IS 16,
5- I AM OPEN FOR ANY OTHER SUGGESTIONS AND ADVICE... I TALKED TO A FRIEND IN A SHERRIFS OFFICE IN ANOTHER STATE AND HE SAYS HE DEALS WITH THIS ALL THE TIME, NOT HELPFUL, BUT GUESS I KNOW I AM NOT TOTALLY ALONE IN THIS. HE SUGGESTS GOING TO THE POLICE DEPT IN ADVANCE AND LOGGING SITUATIONS AND TELLING THEM OUR CONCERNS, I GUESS LIKE THIS BLOG, AND LETTING THEM NOTE FILE AND NOT BE CAUGHT BY SURPRISE.. HOWEVER SEEMS RISKY TO ME AND TOTALLY LEAVES MY FAMILY AT THE RISK OF A PERSON OR WHAT IF THAT OFFICER IS OFF THAT DAY.... JUST NOT AT PAECE WITH THAT
THERE HAS TO BE SOMETHING I CAN DO, SURELY SOMEONE OTHER THAN ME HAS BEEN THRU THIS BEFORE?
HELP..... I CANNOT TAKE ANY MORE, I AM AT MY END...

I have a friend who was recently arrested for possession of marijuana and a controlled substance (Prescription drug).
My 2 friends were riding in one of their friends cars, who then got pulled over for a broken windshield (cracked). They pulled him over, and according to the police, while they were stopped and about to come to the car, there was movement in the back seat, and alot of movement. SO the cops pulled him over went to the door, and ended up searching the car. they then found several baggies of marijuana, and several pills which were identified as clonipine. they then arrested my friend and the owner of the car who was in possession of the drugs. Which doesnt make any sense whatsoever, because he was in the back seat, and the drugs were under his seat. He posted bond at a ridiculous amount of money totaling up to almost $26,000. for just 2 charges. Is this friend of mine, going to end up serving a high sentence for this crime? that he didnt even have any involvement in? he was in the wrong place at the wrong time. My question involves criminal law for the state of: Georgia
I was at a college football game and upon entering the stadium a cop stops me and states, "I remember you!" He continued to talk about an incident that happened about 7 years ago when I was a freshmen in College. I ignored the statement and we took our seats.
I was with a group of friends. We were in the student section of the stadium where it is common practice to stand up on the bleachers for the entire game. While standing on the bleaches my friends thought it would be funny to keep pulling on my shirt and making me step off the bleacher backwards.
The same cop comes up to me and says, "Easy way or hard way." After explaining himself I said I thought it was gay he was kicking me out but I will leave.
About 5 feet from the gate I turned around and extended my arm to shake his hand. I stated, "I apologize, I know you were just doing your job." He pushes me and said leave. I repeated myself one more time but before I could finish he arrested me for Public Intoxication.
Upon reading the Incident Report it stated that I was yelling obscenities. My question for you guys is, How can they prove I was yelling anything (since there were 15,000 other students around me yelling as well) unless that cop targeted me from the beginning because he recognized me. If so is it legal for a cop to zero in on one person?
I was about 5 rows down from where the cop was standing so he must have been paying close attention. He waited till the exact moment my Fiance left to go to the bathroom to come down and confront me.
I don't want to pay for a lawyer simply because I am getting married and don't want to spend the money.
I found a lot of pictures of this cop on Facebook drinking and quotes from him bragging publicly that he arrested someone and it was a great night. He also drops the f bomb a lot on his public site.
Can I use that information plus my two eye witness statements from the people standing right next to me to prove that there is reasonable doubt that I did what this cop said I did?

| My son just informed me yesterday that he has court on Tuesday for having been pulled over (he was riding, not driving) and cited for admitting he had drank 2 beers. When he was asked if he was drinking, he first said no and offered to blow a breathalizer. The officer said that would not be necessary that his other friend had told the officer my son was drinking and if he would just admit it, he would not take him to jail. Don't like those tactics (any recourse there?) but my son is 18 and was breaking the law. The other issue is the fact that he somehow believes as a first time offender (I am sure he has friends who have gone through this who advised him), he will get off with a $300 fine which is why he never told me until now. I am not so sure - what has been your experience with this type of incident? Someone advised me that he should go into court and proactively demonstrate that he has taken a Alcohol/Drug Awareness class and detailing any volunteerism and community service he has participated in since the incident. He just joined a fraternity and they have to do a minimum number of hours of volunteer work every week. I really want to contact the court and beg for a continuance so we can get our act together (at this late date, not sure they will grant). What is your advice?

Ok...in april 2001...I pled guilty to a felony drug charge. I was stopped by the police and after searching my car they found 2 crack pipes. I was given 5 yrs probation,$1700 fine,counseling,24 hrs communtiy service...I made this agreement by myself without a lawyer...beacause the lawyers I talked to
couldn't give me anything better....so how do i expunge my record...now
is it possible and how much would it cost?

| Greetings I was on probation that I completed successfully.One day I was stopped by the law for a minor traffic violation,and when they ran my license they said I had a warrant for not completing my probation.I found out that the probation board contracts there work out to some organization who never cleared my record.My probation officer got it cleared up and after a night and a day in jail I was set free with there mistake corrected.The sad part is I was on probation for things I didn't do I was a passenger in another persons car where they found 1/10th of a gram of marijuana somewhere in the car and a open container that belonged to me.I was charged with a dui for just riding in my friends car.when we went to court they give me a dui,and took my license.The driver didn't have a license and they gave him an affidavid to drive back and forth to work.Normally if I was guilty I would take it like a soldier,but they falsly arrestted me because the people the parole board contracts to clear people of there probation never did can I sue them.My father is a veternarian if he makes a mistake believe me the law suit come quick.I want to fight back,and wondering if it's worth the trouble,and how much could I actually sew them for.

a few years ago I was in a very abusive relationship. We got in trouble together and I was a first offender, never even had a parking ticket! anyhow I was arrested and charged with misdemeanor shoplifting. I was given a PTI (pre-trial intervention) and told that if I did not get in to anymore trouble then I could have my record expunged. I was not able to get out of the relationship and more bad things happned. I violated probation and was given 30days in jail. I got out of the relationship with help from my parents. I successfully finished probation and with the help of my probation officer, the prosecutor, sheriff and judge I got an expungement.
the problem now is that I went to get a records check for school, I am at college getting a degree to one day be a special education teacher, and my record came back denying that I could be in the program.
I called the GBI and GCIC and both places stated that they could not find a criminal background on my at all. I went to the police department where I live and they gave me a copy of my background check. I found the problem!
the problem is that the violation of probation was a seperate offence from the misdemeanor shoplifting and was not exponged.
I was told that because I served time that I could not get this exponged. is there anyone that knows diffrently? can I get this exponged?
I doesnt make sense to me that the first charge was exponged and the second charge, which is dependent on the first, stayed. because the second one is there with out the first is says status unknown instead of misdemeanor or felony (thats really the problem, I could be a teacher with a misdemeanor, but I really want it exponged)
should I hire a lawyer to look in to it? I am calling one tomorrow.

I'm a 21 year old male and was arrested last night, taken to jail and charged with DUI and failure to maintain a lane.
Story:
I was pulled over 3AM by campus police of North Georgia College and State University minutes before parking my car to visit a friend. The officer said he pulled my over because I came down the hill too fast then said he could smell alcohol on my breath and asked if I could do a field sobriety test. I was asked how many drinks I had throughout the day and I said it was a few beers several hours ago.
Being an uninformed fool, I agreed (big mistake) to the FST. Then the officer continued to ask questions about my day, who I was visiting, where I lived, what I was doing out this late, etc.. I politely answered all questions. Then the campus officer calls the city police. The county officer checks my eyes by following his finger. Then asks if I want to take a breathalyzer test for positive or negative. I agreed again (big mistake again). The mobile breathalyzer which is not calibrated and can't be held in court pulled a 0.081.
Then I was asked to put my hands on the police car and was cuffed. Then taken to the station and was tested again and pulled a 0.092 at the station. I was booked, printed, etc. I had to bond my self out for $1900.00 at 10AM. Had to get my car out of the impound.
Now what should I do and what are the consequences? I know I have to appeal for a hearing within 10 days for my license but as far as the fees, punishment, and penalties? Should I get a lawyer? If so, what can he or she do?
I'm a full-time student and don't have a steady income. I'm hiding this from my parents at all costs because they are unemployed right now as well. I'm really worried about my future and just in a mess right now.
